Rhode Island Case On Sal’s Side. (Didn’t You Shepardize This David? Tsk, Tsk) – WITH POLL

A Rhode Island Superior Court judge ruled last month that the Speech and Debate Clause under the Rhode Island Constitution, which mirrors the Massachusetts one, forbids the R.I. State Ethics Commission from prosecuting a legislative leader.

OK OK, it is another state and it is not an appeals court decision.

But it is on point and it shows that Sal’s argument has merit. And it will make its way to the R.I. Supreme Court.

David, will you be returning to Jim Braude’s show with this new, yet previoulsy available, information? You can also discuss the newly learned, yet also previoulsy available, fact that there was legislation surrounding the Cognos crap.

From the news piece you cite:

Darigan ruled that the two provisions can both apply. Legislators get immunity for acts within "the parameters of their legislative positions," like "proposing, passing or voting on legislation," he said, while the commission can enforce the ethics rules where non-legislative activity is concerned.

The issue in our fair state, it appears, has nothing to do with "passing or voting on legislation."

In fact, that is the whole point.

The Cognos issueis about legislation. Specifically the supplemental budget allocating $6.2 million to pay for cognos software. That is what they were doing in the legislature - advocating for a certain piece of legislation.

The legislature is doing due dilligence when it inquires and shows an interest, and gives imput for how proposed legislation would be implemented.

      Ask David, he'll tell you.

Didn't you read my brilliant analysis?

So take that "next" remark and stick it up your Cognos

      Ask David, he'll tell you.
