First Off. Whoever wants to sue the Commission for not playing fair should bring it in federal court. (David, any jurisdictional problems?)
The judges in The Moakley Building are genetically wired to believe anything coming out of Beacon Hill is highly suspect if not criminal. And they ain’t afraid of no governor or attorney general or former fellow MA Superior Court and Appeals Court judge (McHugh) or the local mob or Steve Wynn or Bill Weld or The Boston Globe. You get the picture? (Okay, they are afraid of the Globe because for the most part they’re Ivy League snobs with little life experience but still better than the state judges on this)
Okay. Let’s project to next week, shall we?
1. The Commission grants Steve Wynn the Everett license.
Result:
Caesars adds some facts and counts (if that have not already) to their ongoing and more and more viable suit alleging the Commission committed a fraud upon it in favor of Wynn by orchestrating a contrived situation causing the casino company to withdraw its application. (Note: I would love to see the complaint from Ceasars. It’s public record but I can’t mosey into the clerks office and ask to see it. Too suspicious. So if anyone has a copy of it could you e-mail it to me? I won’t tell where it came from.)
Mohegan Sun sues and asks for injunctive relief stopping the issuance of the license. Can’t wait for that hearing.
Suffolk Downs joins in.
A Charlestown resident or two backed by a newly formed well funded neighborhood group making the case that the Commission erred by not declaring Boston a host a community thereby denying their right to a vote. Seems the more we read about Wynn’s plans and the Commission’s efforts to hide them the more it seems the casino will be in Everett AND Boston.
The City of Somerville for getting screwed o the illegal arbitration process they were forced to participate in.
The City of Chelsea for the same reason as Somerville.
The City of Revere for the same reasons as Somerville and Chelsea plus the same ass-aches as Ceasars Mohegan Sun, and Suffolk Downs have.
The City of Boston but who cares when we have this cast of characters ready to charge ahead.
I think a request for injunctive relief would be successful here.
2. The Commission grants the license to Mohegan/Suffolk Downs/Revere
Wynn and Everett sue because it’s not their fault the state decided to load the Commission with idiots like Crosby and Lynch.
I don’t think a request for injunctive relief would be successful in this scenario.
3. The Commission votes not to grant a license to either applicant.
Everyone accept Chelsea, Somerville, and Boston sues in that version of events.
BTW, if that happens the casino foes still should go forward with the corruption argument because the Commission can always award the license at a later date and that’s probably what they’ll plan on doing. You know, after the heat dies down.
4. The Commission splits 2/2
This would be the best result from the entertainment point of view. Judge McHugh’s video taped deposition would be comedy gold.
5. The Commission votes 2 for Everett, 1 for Revere, and 1 for neither. Or 2 for Revere 1 for Everett and 1 for neither or 2 for one and 2 for neither or..(you get the picture)
I don’t know what that means. Does the winner need at least three votes? Whatever, still lawsuit city.

and losing revenue and closing down all across the country, by the time this Massachusetts casino fiasco is settled in the courts, it will be like the Massachusetts finally deciding to go with cassettes and not 8-Tracks on all state vehicles in 2015.
I can tell the legislators who back casinos are not gamblers. This is a losing hand and anyone with half a brain would have folded a long time ago. Then again, maybe some are pot committed, poor bastards.
