Personally, I don't think the legal issue is as cut and dried as daves suggests, or that the NYT et al missed the point. The very fact that this issue is being debated, however, is evidence that President Obama is a long way from the chief executive he promised to be when he ran for office: the larger issue. What the effect of that will be in 2012 remains unclear. - promoted by Bob_Neer

(That is actually cool. Particularly in Daschle's absence, there's going to need to be an absolute steamroller of public support for universal health care legislation. (This is a good point. Obama's plan is not truly universal -- at least not yet. Now, it remains to be seen whether Hillary's plan would leave significantly fewer than 15 million uninsured. The experts seem to think a mandate could get it down to 5-8 million or so, but that's still not "universal health care". - promoted by Charley on the MTA)
