A guy on foot. A guy more than likely running through backyards etc. which I assume the bomber was doing Thursday night.

Would you have your people check something like the the famous backyard boat or do you see it as a needle in a haystack?

The driving directions are less than a half mile. Less running through yards I presume.

If you look closely at the location on the left you can see the boat in the back yard. Follw the short trail to where he fled from and make note of the other back yards clearly visible. (note, you will have to zoom in one more notch to see)

Do you see anything similar in other backyards? I see is empty backyards mostly.

When checking the “usual places” where one would expect to hide when fleeing on foot, coupled with the resources on hand, the severity of the crime, the likelihood of deadly consequences if the individual is not captured, and common sense is there any reason why the suspect was not discovered there earlier or, if not there earlier, observed moving through the neighborhood before coming across the boat.?

Mother Zubeidat Tsarnaeva told Russia Today that the FBI had been checking on Tamerlan for three to five years.

“They knew what he was doing, what sites he was visiting. And we know that on Monday Boston P.D. immediately began confiscating video of the area. Based on reports that the F.B.I. was in charge they most likely directed the B.P.D. to either analyze the videos/pics or deliver them to the feds. I’m guessing the latter.

We also know that since this was characterized a terrorist attack from the get go and we were told there was “an all hands on deck, no leaf unturned” effort being made the feds. I suggest we can assume they were analyzing their files and other sources for anyone and everyone who might have done this. This obviously would include disgruntled runners who didn’t get numbers, the hat guy, and locals in their data base who may have any possible connection.

Can we assume that the Bureau ordered relevant agents to review files, especially pics (and memories) and compare them with those in attendance anytime near or around the blast? Or a similar analysis?

Can also assume they have cutting edge facial recognition software so photo data bases could be compared. Visas, passports,  F.B.I. FILES, even drivers licenses. If so, should not the brothers identities have turned up without requiring the public help on Thursday?

Now I am not good at estimates but how many law enforcement personnell were assigned to this matter. And, although not complaining, I agreed with the show of force, can we agree at times we saw what appeared to be more than enough uniformed and plain clothes police personnel in safe zones keeping the public back.

How big is the F.B.I.’s list of locals who are like the one a foreign country asked us to check out? (dead bomber) Is it bigger than the Manhattan phonebook? Boston’s? Scranton’s? Mayberry’s? Is it so large that law enforcement personnel could not be assigned to watch each person until the bomber(s) are caught?

Should these guys have been watched, if not arrested, before Thursday’s police killing and attempted massacre?

Were these guys being pressured by the F.B.I. to become informers? (okay, even I think that’s a stretch, but ya neveh know)

Am I an asshole for wondering?

Where was the F.B.I. during the last few press conferences?

The staties screwed up by not finding the guy in the boat. Thank God nobody was killed because of it.

Did the F.B.I. screw up by at the very least not watching the oldest brother after the bombing? Would that have prevented the killing of the young officer and the shooting of the other?

An unprecedented show of force. Yet a a covered boat in a backyard about a half mile away was not searched during the “manhunt”. The citizen who discovered him after law enforcement’s retreat could have easily been killed.

If you gave a classroom of fourth graders a google earth picture of a mile radius and ask them where they should look what do you think they would say?

Now suppose you are the guy next door to the boat owner and, although told not to, your young kids have climed on and around that boat. Suppoose there are kids always playing in that yard. Now you’re sitting at home watching law enforcement perform oral sex with each other and the media willingly jumping in to this orgy how angry do you think you will become?

“You bastards” is what he’s thinking. Right now that sentiment is percolating through Watertown.

All that bullshit and they didn’t check a covered boat on a trailer in a backyard. In full view of helicopters.

What could have been?

The legislature’s post audit committee, the one with subpoena power, should get them all up there (state and local officials I mean) and make them explain their bloated budgets, their equipment, and how they were used to capture this guy today. How much money in manpower, how much in all the tanks etc. You know? An audit.

Heads should roll.

After major events like this the different agencies involved usually do an extensive and often expensive review for future training etc. This one should be one sentence and cost ten cents to produce.

Was it all for show?

David Boeri reported on WBUR that the Watertown “parameter” ended at the house where the now infamous boat was found. Soon after the residents of “the parameter” were given the the go-ahead to leave their homes a civilian walked outside and noticed blood on and/or around the boat. He immediately called 911.

A state police helicopter equipped with heat sensing cameras zeroed in on the boat and reported the seeing something consistent with a person and very still. Upon reporting this law enforcement made use of a stun grenade after which the heat sensing cameras saw movement. Thus he’s alive.

Every covered boat (and there are hundreds within five miles), plus sheds etc should have been flown over and examined by helicopters with the special cameras. Obviously, right folks? Am I missing something.

BUT FOR the bad guys killing a cop last night resulting in the car chase by officers not involved in the investigation AND BUT FOR a civilian finding the guy in the boat would the brothers be dead or in custody right now?

“The case of John Connolly being so intricately interconnected in events surrounding James “Whitey” Bulger inveigles me into involving myself in it. This lures me away from continuing my review of Whitey’s life. I must return to that. Yet before doing so I’ll directly facing the inanity of Connolly’s Florida conviction for murder on a factual basis, rather than discuss the legal issues.

Connolly likely will die in prison. He’s already served as much time as John Martorano a man born four months after Connolly in 1940. In 1990 Connolly retired honorably from the FBI where he had served since 1968 running Top Echelon informants. In 1990 Martorano had notched in his belt twenty murders by his own hand, and brought about others. He was hiding out in Florida fearful of going to prison.

In 1995 Martorano had just been arrested in Florida. He was held on bail pending his racketeering charge for which he faced 20 years in prison. That year, Connolly would be into the 5th year of a cushy six-figure job with a public utility.

In 1998 Steven Flemmi, an associate of Martorano and an informant for Connolly, admitted in hearings before Judge Wolf that he had been an FBI informant. Flemmi, who probably noses Martorano out as the most evil person who ever lived in Boston, testified about his doings with Connolly. Martorano sat in court listening to him.

These murderers, Martorano and Flemmi, had no trouble taking other lives but neither on could tolerate being in prison. Martorano said of Flemmi that prior to his 1995 arrest among all the “organized-crime types in Plymouth [jail]” he “had never done any time.” Martorano pretends he was a hardened veteran at doing time. He did three months in 1978 at Plymouth for gaming. In 1979 being charged in the Race Fixing case, he fled for 16 years until his capture even though he’d only have to have done about 2 years.

Martorano wrote of Flemmi that “at the age of sixty, he was not doing “good time”” and he was “waiting for someone — anyone — to ride to his rescue.” He began “attending religious services of the Jehovah’s Witnesses.” Knowing his weakness and seeing him testify, Martorano decided he was going to save himself. He’d become a federal witness. He, Johnny, was not going to spend the rest of his life in prison. He’d do whatever was necessary to work out a deal before Flemmi did the same. He knew if Flemmi got to the altar first, he’d be sunk since Flemmi knew of his murders.

He got himself a good attorney to work with. I figured their conversation went something like this. Lawyer: “Johnny, to get a deal you’ll have to come clean on what you’ve done.” Martorano: “Yah mean, tell them everything. Don’t hold nothing back?” Lawyer: “That’s how it is, Johnny. It’s like jumping in a pool. You can’t stop after you get wet to the ankles.” Martorano: “You don’t know what I’ve done — you ain’t got no idea. No one will deal with me.” Lawyer: “Look Johnny, no matter what you’ve done, they don’t want you, they want Whitey and Stevie and that FBI agent.”

Martorano: “You sure?” Lawyer: “I’m sure. But Johnny, listen, the more you can tell them about them, the better off you will be.” Martorano: “I can’t. I’ve murdered dozens of people. They’ll never deal with me.” Lawyer: “They will Johnny. You tell them everything. If they won’t give us what we want, nothing you say can be used against you. This is your chance to clear the deck and put everything behind you. I’ll protect you.”

Like Connolly’s job was to protect his TE’s, Martorano’s lawyers job was to protect him. Martorano and his lawyer laid it on thick for the prosecutors over the next year. He saw the juicier he made his tales and the more he involved the others who the prosecutors had targeted in what he had done, the happier the prosecution team became. Chief prosecutor Wyshak would sing his praises at how accurate his recollection of events were.

He’d eventually bind well with them to the point they’d consider him an ally and a good guy. They even came up with a scheme according to Martorano where to make his deal look better he’d agreed to testify against people he didn’t know. They liked pulling that little con on the public. They laughed at his jokes when he testified in court.

In appreciation of his work they gave him $20,000 upon his release from prison in 2007. A $1,000 for each of his murders. Martorano probably wished he confessed to more murders.

Martorano, a man who murdered more people than almost anyone else in America, was a free man. He had money in his pocket. Connolly, a man who brought down the Mafia and never fired a gun at a person, was in his fifth year in prison of a ten year sentence.

Connolly had been convicted of one offense which occurred during his career as an FBI agent, giving a case of wine with $1,000 to John Morris, his corrupt supervisor. Morris admitted he had tried to get Whitey killed by telling the Boston Globe he was an FBI informant.. Connolly had been acquitted of the nine other charges relating to his time working as an FBI agent.

He was also convicted of other charges that related to what he had done four or so years after he left the FBI. I’ve never argued he was unfairly convicted of two of the charges. I admit his sentence was harsh.

In 2008 Connolly was convicted of murdering John Callahan by means of a gun in Florida. Tomorrow I’ll talk about Martorano’s and that murder.”

Sooo, here is Matt’s answer (please pay particularly close attention to the Florida case and why Connolly is sitting in jail for what all agree, including prosecution, was the conviction of a crime occurring years before the statute of limitations allowed a conviction. (second degree murder) You may also wonder about the needed element of a gun for the conviction and the way the prosecution found one.

Or perhaps you may ponder why the Supremacy Clause of the U.S. Constitution is ignored, as opposed to the Ruby Ridge government sniper from whom Montana (I think) was forbidden from prosecuting for murder?

Or maybe, just maybe, you will have questions of why Assistant U.S. Attorney Fred Wyshak was the state prosecutor?

“I’m saying that in Boston John Connolly was correctly committed of lying to an FBI agent and obstructing justice by sending Judge Wolf a letter alleging that there were illegal wires that provided the evidence against Flemmi and others. For those crimes he was committed ten years in prison. He was acquitted by a Boston jury of all the serious charges including tipping off the gangsters that Callahan may be a weak link. He was convicted by the Boston jury of tipping off the gangsters to flee, which I believe the evidence shows he didn’t do. He was also convicted of giving his supervisor a box of wine with $1,000 in it. I agreed with that at the time but listening to the small part of Morris’s testimony in Florida seems to cast doubt on it. Even had he been rightfully convicted of those crimes, then the sentence he received was still at the top end of what he could receive.

The Florida prosecution I believe is a travesty of justice. First, he was again tried by the same prosecution team that had lost the same charges in Boston. A person is supposed to be tried once for a crime. We have a theory that in the US we have two sovereigns, the federal government and the states. Therefore technically the state can prosecute him. But here the state was used by the feds to prosecute him a second time. Although done under the auspices of the state, the spirit of the double jeopardy provision was violated.

That doesn’t end it. We have a long held doctrine that person working for a federal agency can’t be prosecuted for any action done while working for that agency by a state. It is called the Supremacy Doctrine. It should have been raised in Connolly’s case but for some reason the Department of Justice refused to do this.

Connolly was convicted on a charge murder with a gun which was barred by the statute of limitations. His lawyers failed to file the motion on time to raise this issue. Also, the judge explained to be convicted of that crime you had to be the one who had the gun and shot the person. The prosecutor argued that Connolly as an FBI agent in Massachusetts would have had a gun without showing any evidence that he had one at the time of the murder.

I could go on and talk about using guys like Martorano who never met Connolly to testify against him but there’s plenty without that. Then to top it off, when Connolly appeals the Florida appeals court issues a one sentence statement “Judgment affirmed.” A guy gets 40 years for murder which has some serious legal issues attached to it and can’t get an opinion by the appeals court.”

And the last thing I believe you and your bosses want is for people to believe you deliberately, yet subtly, manipulate the web versions of the NYTimes/BostonGlobe media empire so armchair historians will never get it right. Right?

Why haven’t you mentioned this ridiculous reporting error? Perhaps you are having a hard time finding the right split hair to defend Valencia, and through him, The Globe’s errors?

Why did you edit out Waldo’s comment which included Valencia’s e-mail defending his depiction of Judge Stearns’ unprecedented removal by the appeals court as him voluntarily stepping down do to his own perceived conflict?

Just so we are all on the same page let us remind ourselves of Valemcia’s exact words in defense of his published misstatements of facts:

it is true that the Appeals Court for the First Circuit granted a petition forcing Judge Stearns to recuse himself. …If your point is that I should be more elaborate for the reader to include the decision, than that’s a different discussion, but the point is the judge stepped aside. For a 250-word bulletin story on the latest Bulger filing, our goal was to be spare and to the point for the reader. Other outlets, including trade publications, have worded it the same way.

Okay students, analogy time.

Suppose you are a sports reporter, editor, or publisher and your paper is covering a Red Sox game. Suppose Alfredo Aceves is pitiching. It’s a nationally televised game in prime time. Everyone can see what’s happening in in person or on TV.

Now suppose Aceves stinks the place out and John Farrell walks out to take him out. As soon as Farrell steps on the field Aceves is shaking his head no and yelling “I’m, not leaving”. Then when Farrell gets to the mound it gets ugly and Aceves pushes Farrell. It briefly goes crazy and Aceves is carried off the field by teammates as he’s kicking and screaming.

Gut that? Now you’re the reporter, the reporter’s editor, or the owner of the paper. What would you think if your paper refers to that incident as Aceves taking himself out of the game? If you were the reporter could you defend that reporting? Milton Valencia could I bet.

He’ll just say ‘that’s how the other papers reported it’. Keep the lie going.

The story you filed yesterday regarding the US Attorney’s filings in the Whitey Bulger case contained two substantial errors.
You wrote: “Bulger’s lawyers had asked Casper to vacate the decision made by US District Court Judge Richard G. Stearns, who recused himself from the case out of concern that he would have a conflict of interest in overseeing the trial.”

Judge Stearns did not “recuse himself”; quite the opposite is true. Judge Stearns actually refused to recuse himself in two written opinions. He was removed from the case in a ruling of retired Supreme Court Justice Souter. The Souter opinion on this issue was a truly historical one. It is very surprising you could make such a glaring error. If the bad information was given to you by a source, you should reconsider using that source. The recusal matter sent waves through the legal community here and across the country. Monroe Freedman, a law professor and federal ethics expert at Hofstra said that “Judge Stearns disgraced himself and the judiciary.” You should read the Souter opinion and the opinions of national legal experts like Freedman.

Your second factual error was your statement, “Casper has indicated she would not revisit Bulger’s request.” This statement is simply not true.

Judge Casper actually said, “I can’t say as I sit here now that I am necessarily going to revisit the issue of prospective immunity.” Casper then invited the parties to submit briefs on this issue within a certain time frame. Your story purported to cover the USA’s filing in this regard. If, as you wrote, the judge had already definitively decided to “not revisit Bulger’s request”, how could you be writing a story about the briefs filed in the closed matter? It is clear that Casper’s statement meant she didn’t see it that Judge Stearn’s unceremonious removal from the case NECESSITATED her review of the immunity issue, rather she wanted to briefs on why she should and should not revisit the issue. In the story you wrote with Shelley Murphy that day, you stated Casper’s position correctly. Now you have two conflicting stories about this with on the web your name on them. The bottom line is that you were way off from the truth and you should have known better.

On an unrelated point, your writing tends to latch onto the USA’s soundbites which they sprinkle throughout their filings. Please note that those tidbits are put there just for you and whether you latch onto them is you prerogative. Please also not they have no place in legal filings other than to guarantee shallow reporters will help the USA try their case to the public and not the court. The USA’s strategy a annoying and anathema to attorneys who read the USA’s brief seeking thoughtful legal analysis and are forced to wade through the soundbites. Examples of the USA’s media tidbits include “a legal game of Whac A Mole,” “license to kill,” “twisted like a pretzel”, “absurd”, “fantastical”, “strange”, etc., etc. There are common and effective legal and grammatically accurate ways to state their position. The USA chooses to pander to the media in filings (and probably through burner cell phones) and then complain to the judge that the defense gave a press conference in violation of the Court’s gag order. By the way, why isn’t the Globe fighting to lift the gag order and impoundment of evidence in this case?

It is very clear you are relying heavily on government sources for your stories. You should really try to seek some balance by including a source in the federal criminal defense bar. The criminal trial process is an adversarial one. You can’t write a balanced story without both sides. Furthermore, it might help you avoid major errors like those in this story.

Thanks for writing. I must say I have to disagree with you, however, but I appreciate your points.

It is true that the Appeals Court for the First Circuit granted a petition forcing Judge Stearns to recuse himself. …If your point is that I should be more elaborate for the reader to include the decision, than that’s a different discussion, but the point is the judge stepped aside. For a 250-word bulletin story on the latest Bulger filing, our goal was to be spare and to the point for the reader. Other outlets, including trade publications, have worded it the same way.

Also, Judge Casper did indeed suggest she would not revisit Bulger’s request. I was in the courtroom when hit happened, as I have been in many of the recent hearings. By all accounts, even Bulger’s lawyers’, that was her tone. That said, she said she would entertain new filings on the argument, anyway. That’s why we wrote the story.

In addition, I understand your point that is is an adversarial system. That is why we wrote not only this brief, but also stories on the two motions for Stearns to recuse himself, as well as the petition to the First Circuit, the oral arguments, and the appeals court’s decision, which went on Page One. We also wrote about the filing by Bulger’s lawyers to revisit the immunity defense. Point being I am well aware of the recent history of the case, which has been covered thoroughly by the Globe.

You should also know that the Globe did try to fight the gag order, and Magistrate Judge Bowler denied our request.

No Milton, your excuses are very offensive and arrogant.

You reported a 38 word sentence stating ‘Stearns recused HIMSELF out of HIS concern he would have a conflict’. That statement is dead wrong. It could not be made correct by “elaborating”. You were NOT forced to report the wrong facts by the word limit on the story. You could have reported the truth in fewer words, “Stearns was removed from the case by the First Circuit to avoid an appearance of bias.” Your excuse is “the point is the judge stepped aside.” That’s false, Stearns did not step aside! He ignored crystal clear law when he twice refused to step aside. He was “removed” from the case . There is an enormous difference and you cannot rationalize your error this way.

Your excuse that ‘everyone reports it the wrong way’ is also vulgar. You can’t point to a single source who mangled these facts as badly as you did, and certainly not a legal trade publication. There’s even a Boston news story today that states “Judge Stearns was removed from the case in March…” (That outlet also included the prosecutor’s “Whac-A-Mole” tidbit that you also isolated from a lengthy legal brief…you guys are so predictable.)

Your excuses are also weak for erroneously stating “Casper has indicated she would not revisit Bulger’s ­request.” You assert this definitive statement is true because you were there and “that was her tone.” If you based your interpretation of her ruling in her TONE then you should have reported that! You should not have reported that the Judge made a definitive ruling from the bench that “she would not revisit Bulger’s request.” Your excuses that everyone thought it was a definitive ruling are false. Here is how another reporter present described her statement, “I can’t say as I sit here now that I am necessarily going to revisit the issue of prospective immunity.” That characterization is a far cry from the definitive ruling you stuffed into the judge’s mouth.

Lastly, the Globe never let’s itself get shut out of a case by a lowly magistrate judge without appealing. To do it in the case of the century suggests you are confident your sources in the US Attorney’s office will leak everything you want (and everything they want you to print). It is obvious you are owned.

That of course was a misstatement of fact. Judge Stearns was ordered of the case by a federal appeals court in an unprecedented decision written by retired Supreme Court Justice David Souter.

Now we all make mistakes and I fully expected this black mark on accurate reporting would be removed. Much like the Globe would fix an incorrect box score.

But no. It’s still there.

This error was pointed out on Matt Connolly’s masterpiece Whitey Bulger blog and Matt commented that The Globe will not change it. They want to continue to mislead, including future historians and armchair historians.

Others suggest that they have to continue to cooperate in the charade because the nefarious relationship the Globe has with Team Wyshak and Margolis

I, always the naive one, did not believe this. But now I am not so sure.

I figure Milton and Brian have been busy with Opening Day on Monday and the amazing 800 game sell-out streakk ending on Yawkey Way. So I expect we will see the change by the end of the week.

But that’s me. Always an optimist and I tend to only see the good in people.

I am an ‘old man’ stoolie which means, although I appreciate the gesture, I scroll through most, emphasis “most”, of the smoke shows etc. and I, like many others, pray you have daughters someday. Strictly for the laughs!

Now to business. I have been busting balls for too many years at a liberal Birkenstock Cambridge type Massachusetts political blog called Bluemass Group. I am not related to the car guy so I am sorry to say this is not about purchasing advertising.

However, I love the fact that you are considering a run for mayor of Boston. I even caught a post you had from an experienced political consultant who gave you good advice.

If I may indulge, allow me to offer advice if you decide to run. There are two areas you need be concerned with: Organization and Message. Because you are so unique you can cut many of the traditional corners and gain significant traction from the get go.

1. Organization: This is what makes you so interesting. One thing to  remember, all you need is people to show up on primary day and election to vote and vote for you. That’s it.

In your case you have college students and twenty somethings. This is your base and you are a trusted celebrity to many of them. These are your disciples. You don’t need them to get their parents to vote for you. You need them to  get their roommates, hall mates, dorm mates, frat brothers, sorority sisters, teammates, co-workers, bros, cuzzez, sistahs, and lovahs of these  18 to 30 year olds to register to vote in Boston, sign nomination papers and go the polls in September and November and vote for David Portnoy for Mayor.

That’s it. It’s a numbers game. Take a look at the numbers. You can have an impact and a voice in the mayors election if you show force in numbers. You should be  at every debate answering and asking questions like the other candidates and there is no reason why you can’t.

Collect as many “valid” nomination signatures as possible. Signers must be registered Boston voters. You can not collect enough for purposes of getting notice. Make-sure you have volunteers check the validity of persons on voting list before handing in to city hall.

At same time and before and after. Basically all the time 24/7 register people to vote. Have them fill out forms but you/campaign collect them. That way you keep count and have names plus you personally turn them in to city hall for publicity purposes.

Remember El Prez, a schizophrenic heroin addict’s vote is worth exactly the same as that of Nobel Prize winning billionaire. Also you are manufacturing votes. Most of your base would not be voting but for the fact that you are on the ballot. There are tens of thousands of people out there willing to register and show up to vote because of you.

2. Message. You need a message when attending candidate events and speaking to the mainstream media. You can’t, in my opinion, be a Howard Stern and just be int he race to shock or gain publicity for your site. I suggest you can gain tremendous and well regarded publicity for David Portnoy which of course will translate to publicity for the site.

A. You are a small business man and understand the problems of running a tiny operation in the city. Statistically this is a huge part of Boston’s economy. You are no different that the shop owners in Maverick Square and Roslindale Square etc. You run around the city meeting clients etc. You have a point of view regarding traffic and parking, litter, potholes, snow removal, city hall red tape and other business stuff

B. You see the Boston’s future because your audience is Boston’s future. What does Boston need to retain the talent here? blah blah blah

Yesterday Whitey’s lawyers were in court asking the new Judge to overturn a decision made by the prior Judge, Richard Stearns.

Stearns was removed from the case after appellate decision written by former U.S. Supreme Court Justice David Souter ripped him apart in an unprecedented manner. Stearns extensive involvement personally and professionally with many of the witnesses and not stepping aside on his own motion was beyond credulity and had Souter perplexed. But the fact that Stearns doubled down and fought to keep the case made Souter go Sonny Corleone on him. In the judicial sense I mean.

The decision is historical for the shear contempt that Souter shows for Stearns’ actions mirrored against his judicial efforts to keep it polite.

BTW, there has been so much poppycock thrown around for years and years on all things Bulger that even Souter fell into the trap when he wrote in his opinion that John Connolly was convicted of crimes while in fact he was acquitted. That’s lazy law clerking I bet, huh David? Google and read Howie Carr to get facts rather than check the court docket?

So anyway in comes J. Carney and asks the court to re-open the issue of immunity, a lynch pin in the case that could open up serious wounds for some of the individuals on the witness list who Stearns had prior professional relationships and current personal relationships with.

Judge Stearns denied it in a most expeditious manner relying on a last minute open ended affidavit filed by Assistant U.S. Attorney David Margolis, the 50 plus year career Justice Department attorney who calls himself the “fixer”.

Okay people, gut all that? Because here’s a piece of how the Pulitzer Prize winning Globe had to report on the hearing

The Herald broke the news this morning. They also did a nice job of video recording the crime as it was in progress. The Herald’s first paragraph lays out the gist of the crime. (BTW How did the Herald ever get in there? I don’t know. But A-1 undercover work guys.)

Suffolk District Attorney and mayoral hopeful Daniel F. Conley — possibly looking to avoid the type of scandal that got former state Treasurer Tim Cahill in hot water — invited reporters yesterday to a mandatory office meeting where he made sure his staff got the memo warning that state law forbids them from campaigning on his behalf while on the clock.

Wait a minute! Dan invited the press to observe this miscreant act. Can this guy be anymore incompetent? The chief law enforcement officer in the county is clueless on this. Do we really trust him getting the snow removed?

So Dan ordered the scores of employees assigned to West Roxbury Court, Brighton Court, Dorchester Court, East Boston Court, South Boston Court, and Charlestown Court, and Chelsea Court to leave work earlier than the 4:30 court closing time and get themselves into downtown for Boston, (most never go there) for what the Herald called a “pep rally”.

Order state employees to appear as props for a campaign event. Close down district attorney satellite offices early so state employees won’t be tardy attending mandatory campaign event. That is exactly what happened yesterday. Clear as a bell.

“…Not on the people’s time, not on the people’s dime,” Conley told his 300 prosecutors and office workers..

“So, you are not allowed to engage in any political activity on any piece of state property, on state time, which means you can’t use state equipment, or state computers, or cellphones, or copiers or fax machines,” continued Conley, who announced Wednesday he is running for mayor. “So please read that memo carefully and follow those rules.”

This meeting was in the lobby of Bulfinch Pace, the private building where the taxpayers rent space for the district attorney. That space was available for this “campaign related” meeting because of the lease between the state and the landlord. Breakin the Law, Breakin the Law

Everything about this press event yesterday was campaign related except the transparent cover the tax payers gave it through Dan’s office.

Were courts forced to close some business early because the assistant d.a.s and staff weren’t around? Did d.a.s have to stop trials and tell the judge they had to leave early for this mandatory meeting?

Should Conley’s campaign re-emburse the tax payers for this transparent campaign gimmick?

Can Conley point to other mandatory employee meetings where the press was invited?

Dan got campaign coverage on this in the Herald today. Just as he wanted.

I particularly love this part in the Herald piece

“While the law allows public employees to … make contributions, I want all of you to know that I will not accept campaign contributions from any employee of this office,” said Conley, who is already sitting on a campaign war chest of nearly $900,000, much of it raised over the past 11 years from contributions from lawyers, cops and his staff. (emphasis added)

Thanks for the dough guys. I won’t be bothering you anymore for money…….at least for now that is.

But what about Cahill? The Herald brings it up

Cahill struck a deal last month with prosecutors that allowed him to pay a $100,000 civil fine and skirt a second criminal trial over charges he spent taxpayer money on his failed 2010 gubernatorial run.
Conley did not mention Cahill in his talk — which was part office pep rally, part stump speech — but he made clear he did not want any ethical missteps, or even appearances of them, to sabotage his campaign. (emphasis added. Breakin the law, breakin the law)

Dan Conley is the current front runner for the mayor’s job. How long before he self-destructs?
Months? weeks? days? hours?

First, the meeting is after work hours yet on government property. Were people paid for the overtime?

Second, was your campaign for mayor discussed in any way? Was it mentioned? Was the meeting about your campaign? Was it to tell people not to violate ethics rules if they were to get involved?

Third, did you violate state ethics laws by ordering state employees to report off hours to government offices to discuss your mayoral campaign? Regardless of what was said if purpose was to discuss campaign it appears ethics laws were violated. Or am I wrong?

Dan, Dan, Dan, you are a light weight. A light weight with a war chest but a light weigh none the less.

You’ve never been tested Dan. Your base is the D.A’s office and cops. That’s the same as no base Dan.

And Hyde Park?  Bahahahah – That’s why Consalvo’s in Danny Boy. You know that. The Mayor hates you. Angelo Scaccia can’t stand you. You ran against him, remember?

Never mind becoming mayor, over their dead bodies are they going to let you win Hyde Park.

It will pass then go to the Senate where it will also pass. Then a conference committee will work out the few discrepancies, back to both branches for passing again,  and off to the governor it goes where it will be vetoed.

So this thing will be won or lost on the over-ride. Perhaps that is what DeLeo and Murray want. Remember, what you hear now is them saying that they enough votes to get this particular piece of legislation through.

So hard ass lobbying needs to be done.

I want to see easy to read info sheets that show exactly what it will cost in breakdowns of miles in cars, increase in income tax for $50,000 income, keep it simple but don’t mislead.

Then show me what I get for this money in simple terms. What bridges and roads are going to be fixed and why.

What new mass transportation projects and why?

Also, have quick ten second fact driven speech knocking opponents argument of the need for each expenditure.

AND hit hard that we are no longer Taxachusetts and where we stand now.

Get this out to the public. Don’t let the likes of Shauna O’Connell, the poor man’s Karyn Polito, be the voice of the ignorant.

Dems should force this hard on the lemming legislatures. Tell them you elected them to show some balls once in awhile. If they can’t then tell them to stop complaining how difficult their job is.

If they can’t go back to their districts armed with facts and tell their constituents why they voted they way they did than they don’t belong in office.

These bastards just don’t take tough votes anymore.

So you go Governor. I hope you are on the phone to every dem in the house and senate.

Call them at home, always good when the spouse answers.

And if there is corruption, and that corruption is damaging the ability of hardworking cabbies to make a decent and honest living, why shouldn’t a spotlight series be done on it? It seems very poignant to me.

  My bone to pick is the call for and the sudden response from the United States Government through the Boston office of the U.S. Attorney for a very local problem.
  This coupled with the obvious unethical relationship this office has had with the Boston Globe and Boston Herald.
  The quid pro quo of the feds feeding these people great “stories” which have furthered among other things the illegal Top Echelon Informant Program started by J. Edgar Hoover and still operating today.

  Isn’t it funny how the Globe or Howie Carr or many of the other frauds refuse to write about or only give lip service to the Caswell Motel attempted heist?

Like the probation mess. What’s this about another grand jury sitting now in Worcester after the other two shut down? Now Wyshak and his buddies have the opportunity to edit, cut, and paste as they try to paint something that is not there. The first two grand juries allow them to see how it plays in Philly abd Boston before opening on Broadway after all the fine tuning is done to the script and the acting.

By the way, anyone hear anything about wires being worn in this investigation?

So now we have this. The Globe just discovered taxi medallions and their worth. Great work guys.

Now they find there’s an immigrant who started out driving cabs now owns most of the medallions.

And guess what else? He’s a prick to work for.  I know, I know, hard to believe. He watches every dime and sets up rules that suck.

He’s worth $250 million dollars and is at his garage in the Fenway every Sox game collecting cash for parking spots.

Is he violating any state labor regulations or laws?  Perhaps? What about municipal code? Perhaps, the industry is locally regulated?

Federal laws? WTF here we go again. Talk about heavy handedness. And speaking of hands how about the on-gong I’ll wash your hand you wash mine between the feds and the Globe (Howie Carr and others also).

Let’s recap.

The Globe sets out write a spotlite series on the cab business in boston.

The identify the target and the guy that owns it.

They hear also sorts of stories like cabs paying dispatchers to get more calls and the owner making them tap off using his over-proced gas.

So Globe reporter Bob Hohler goes under-cover as a cab driver. (On the radio today Brian McGrory refused to admit he was undercover. Bizzare, huh?

The industry is based on independent contractors renting cabs from owners. Each cabbie is an independent contractor.

So Hohler enters into a contract to drive a cab with an entity owned by the immigrant.

Now right there bells should go off when the owner’s lawyers’ looked at these stories. It seems to me that Hohler violated implied terms of fair dealing and clean hands and all that. How can he have acted in good faith when he was being paid considerably more money at the same time to write a story with the purpose of harming the owner?

Can he deny that his goal expose criminal activity that would gain the attention of the U.S. Attorney? One with whom the Globe a record of quid pro quo – ( for example still looking for stories on Caswell Hotel and Congressional investigation, never mind their working with corrupt feds trying to pull off a hit on Whitey Bulger)

Do the facts in total, and not selective and anecdotal stories written to inflame, call for a federal investigation? In other words is this akin to calling 911 and falsely accuse someone of a crime by knowingly hiding important facts?

That’s what I want to know.

His duty was owed to the Globe and not the terms of the contract he agreed to. Therefore the owner’s lawyers are entitled tot see everything he learned and what he chose to report? I see the this very wealthy owner coming after the Globe and coming after them hard while at the same time sending the feds packing.

Discovery, depositions, Hohler, editors. Tell us about all communications with the Ortiz’s office regarding this.

I mean at the very least Mr. Hohler and the Globe violated Massachusetts Consumer Protection law Chaper 93A as it applies to contracts between businesses.

On the same note folks please don’t ever forget that The Globe is a for-proft business. They are not better than you and I in anyway. Their opinions are no better, they are extremely bias,  and everything they do is inherently tied to money. That’s business folks. And the newspaper business is no different.

But what’s more important is yet another farce is being put on stage. Now the Globe will get all our attention on this. Why call in the feds? We all know that the feds can find a problem anywhere they look.  Oh right, because they are puppets of the feds and this is the quid pro quo.

BTW, while a cabbie Hohler got in an accident then allegedly lied somewhere along the way. Fist he said he ran a red light then he said he didn’t. Bahahahaha

I hope the injured party sues. The Globe’s insurer should pay, not the taxi’s. Hohler was working for the Globe at the time. More depositions and discovery. I suggest J, Carney reach out to this person. Without violating ethical restraints of course  She may need a lawyer.

The accident sounds fishy? Why run a red light? Was he trying to cause an accident so he could see how it all end up? That was what one of the three parts of the spotlite series centered around, personal injury cases in cabs.

Anyhow, if anything, I see a need for an upgrade in legislation and better enforcement of livery laws.

Oh, one more thing. How about Kevin Cullen suggesting that this Spotlite series was the cause of Menino not running agin?

Margolis is the man that manipulates the Bureau of Prisons into torturing people through sleep deprivation, isolation, severe temperature, and any else that forces a person to testify in court to what they want. How many proffer’s have been rejected and the guy sent back in for some more marinating and come back out with the right story.

1. Andrea Cabral gets elected to state constitutionally defined position (Suffolk County Sheriff)

2. Her pay, like all elected positions is a definite amount defined in the law. It takes a vote of the legislature and the signature of the governor to increase her pay or give her any benefits than those defined by statute. Such as health insurance and pension benefits.

3. No statutes exist defining vacation days and other many other perks available to non-eleceted employees.

4. Been this way forever.

5. Upon leaving the Sheriff’s job a few months ago she put in for and received unused vacation pay. $12,000 +

6. She is currently the Secretary of Public Safety. She is the head of the State Police.

7. Every elected official knows they can make their own vacation day. Take off 360 if they want. Just have to answer for it come election day. Andrea can take one week, 2 weeks, 3 weeks 4 weeks or 30 weeks of vacation. She can give herself 100 sick days and 33 personal days. But guess what? It means diddlly

8. But that’s what Andrea did. She defined unilaterally and illegally defined benefits for herself and then paid herself off  with state money for not using what never existed..

Recently, before Andrea arrived at her current job, an employee with a minor position in the Department of Public Safety was run out of state government and held up to public ridicule because during the 25 years plus she had a driver’s license there were a few speeding tickets and a few rear-enders. But because she was in charge of promoting the road safety for the state the vultures had the red herring they needed to make great irony needed for the lynching. Good job boys.

For those who don’t know Andrea, the former Suffolk County Sheriff who resigned her job for an appointment by Deval to his cabinet, cashed out of her Sheriff’s job with unused vacation pay.

You heard me.

Unnn, Andrea sweetheart. You were elected. A constitutional position.

No one in the history of state elected office, (I’m pretty sure I’m right on this) has ever gotten un-used vacation time. No one has ever asked for it i bet.

It doesn’t make sense. It is illogical.

You set your on vacation schedule. You can’t decide you’re entitled to four weeks a year, use three, and then cash out with an extra weeks pay for every week worked. That is what Andrea did to the tune of 12 grand plus.

Has the new sheriff done his transition audit yet? Now that I see this the whole sheriff’s department is suspect.

Another attendee will ask Kevin to compare and contrast the federal charges accusing John Connolly of knowingly allowing wise guys to be killed to what Cullen did when he tipped off wise guys that Whitey was an informant.

BTW David, John Connolly was acquitted of those charges in federal court. The evidence was highly sketchy. Unlike the facts showing Kevin Cullen tried to have the White Man killed.

He has detailed much fiction over time but his comic strip can be summed up in two undeniable facts.

1. John Connolly was charged with tipping off wiseguys (Bulger and Flemmi) about other wise guys informing. This according to Cullen and the Feds were death sentences on the wiseguy rats. And no person has the moral or legal right to effectuate another’s death in such a way. Society has rules for such things.

2. Well before Whitey Bulger was indicted and still to be found at Castle Island Cullen and The Globe wrote that he was an informant for the F.B.I.  The few times Globies were questioned about a moral dilemma they basically laughed at the notion. Never entered their mind.

3. Today Cullen is kicking the crap out of a fine lawyer and governor’s council member by the name of Terry Kennedy because Kennedy has concerns about a judicial appointment before the council. The nominee is a former federal prosecutor who unethically IMHO went after a top notch criminal defense lawyer (you could say mob lawyer in the best sense if there is one) by the name of Joe Balliro.

A former U.S. Attorney by the name of Edward Harrington was the trial judge. He directed it out. That is a judge’s way of saying “How dare you bring this piece of shit to my court room!”. The facts of that case were ridiculous. Balliro was targeted because he was very good at what he did and became personal within the U.S. Attorneys Office and everyone knew it.

Really people, these people at the Joe Moakley Employment Center for the Mentally Deranged and Socially Retarded have zero oversight. Niltch, Nada.

And our elected officials are letting it happen. Can you blame them? Look what happened to Ted Stevens.

I want Steve Lynch going after them from the Senate just like Liz Warren is going after the banks. Fucking Batman and Wonder Woman team up to save the good ole U.S. of A. (If Ed Markey said he was going after them he would have my vote and full support)

Clearly he was illegally and immorally destroyed from every possible angle. Just like John Connolly.

Interesting how Assistant U.S. Attorney Fred Wyshak’s name runs throughout both cases. Even at the state level. His tenacity is to say the least impressive.

Question, why is it that the more I read about Fred Wyshak and the things he has does to make sure testimony is “truthful” the more I think of Annie Dookhan? Just saying.

So anyway as I became more familiar with the case one thing struck me.

Kevin Cullen and the Boston Globe knowingly aided and abetted the attempted murder of Whitey Bulger. Exactly what John Connolly is serving 40 years in Florida for. The murder was successful in his case.  (Note: This was after being found not guilty of the same charge in the federal case here in Boston. Double jeopardy you say? Hahaha, that’s so cute. So much learn about the U.S. Attorneys’ office my friend, so much to learn)

John Connolly was indicted by the feds and state of Florida for letting mobsters know certain wise guys were informants. This act, it was reasonably argued, was a death sentence for those informants. The proof of course was when they ended up dead.

So years ago when Whitey Bulger was still around and folks like Matt Connolly were working feverishly at the state level to indict him, Kevin Cullen learned from his handlers, I mean “sources” at the F.B.I. that Whitey Bulger was an F.B.I. informant.

So what did the Globe do? It printed it. So to the F.B.I., Kevin Cullen, and The Globe it’s obvious that the life of Whtey Bulger is worthless as opposed to other murderers and hoodlums. I’d like to know what Deity the pray to and code of ethics they adhere to when deciding who lives and who dies?

This all came out in court when corrupt yet immunized F.B.I. supervisor John Morris admitted he wanted Whitey killed for his own corrupt and immoral reasons so he used Cullen and the Globe to get the hit done.

Next time you see family members of dead wise guys and young women killed by their boyfriend and notorious women beater Steve Flemmi usually with Mob lawyer Tony Cardinale holding their hands and complaining how Catherine Grieg and John Connolly are among those responsible for their loved one’s death ask yourself about the morals of Kevin Cullen and The Boston Globe.

If John Connolly’s been indicted and convicted for tipping off other mobsters about a rat shouldn’t Kevin Cullen and Globe editors also have been indicted?

So Carmen Ortiz is dragging long time Assistant U.S. Attorney Fred Wyshak to Washington with her to face some grilling from Congress on how her office operates. Can’t wait to see fast Freddie on the hot seat. This man has much to answer for.

Matt Connolly, the retired prosecutor who chased Whitey Bulger more than any other has been detailing Wyshak’s and others unethical, if not illegal, actions as they accuse and accuse and accuse.

Through documentation and thorough analysis he makes Dick Lehr, Kevin Cullen, Shelly Murphy, Howie Carr and  pretty much most of the local media out to be patsies, fools, or co-conspirators. No one wanted Whitey more than Matt Connolly and Whitey hated him and his office more than anyone or anything. So you would think Matt Connolly would be a simpatico of the feds.

But we all know he was a fundraiser for Tim Murray.

Okay. Does that mean Murray did anything wrong? What could have he done?

Does anyone really believe Murray was taking cash donations? Of course not. Why would he? Easier to take bribes for judgeships, and good luck doing that.

Now that doesn’t mean McLaughlin wasn’t asking people for cash. By all accounts the guy’s a weasel.

But the feds have held off on sentencing McLaughlin. Supposedly he’s cooperating.

So sleaze bag Mike McLaughlin is working with the feds in the hopes of staying out of jail. They couldn’t get him for theft or something serious. Just that he filled out a form wrong. Then they threaten him with serious jail time if he doesn’t cooperate.

We all know what “cooperate” means. It means “Give us Tim Murray. Whatever you say we will make sure the jury believes it”

I am starting to get pissed off, afraid, concerned, disappointed, sad, and lonely with society’s insistence of promulgating rules that go against human nature and punishing violators with over the top public humiliation and punitive measures.

The case de jour is the poor bastard Boston cop who decided to pull a car over one night and low and behold it’s the commissioners son. And he had a few in him.

What to do what to do?

Well in my opinion he should have done what every good cop could did years ago when he pulled over the son of of the commissioner, a fellow poolicie officer, or a guy who knew a guy who knew a guy he knew.

He brooms it. Everyone gets a break.

99.9% of the time the young kid is ashamed but goes on with his life and becomes a doctor, lawyer, tradesman, C.P.A.. cop, fireman.

Could he if he had the arrest? I don’t know.

And don’t forget all the first offenders who knew nobody but the cop saw someone who deserved a break.

Tens of thousands of them out there. Raising families, paying taxes.

And cops know whose who. Including kids that keep getting into trouble. Usually after two or three run-ins they turn the screws on the kid. No more favors. Fuck him.!!! Cops are like everyone else. Their off-spring go in all directions. They know the code. No breaks after it’s apparent the kids trouble.

That’s how a society works. That’s how police stations should work. Bit now they don’t want discretion, Discretion is an important part of the job.

Society wants to take away discretion. Thaty’s Orwellian people, Orwellian.

But not today. It’s kill kill and be killed. This poor cop did the right think and now he is being investigated.

Meanwhile the cops that killed and assaulted innocent college kids during our baseball and basketball championship celebration go unpunished.

If your kid wants to go in the police force I suggest you remind him of the dangers. The hundreds of them. The last and least important is that they could get killed in the line of duty. All the others have to do with inside baseball down at the station.

That ex-cop in L.A. killing other cops is the perfect example. Check out what they did to him. He saw a superior kick and assault a mentally handicapped guy. He reported it. Evidence supported it. The force said he was lying and fired him for making false accusations,

I see on CNN a former L.A. Police psychologist saying the guy has to “let it go”.

NO shit sherlock. But you know what? Statistically when you fuck with as many peoples lives like you do to protect the institution you will have to deal with the percentage that mentally can’t deal with it.

Let me give you another real example. A forget which one, but in one of the wealthier Boston suburbs there was an abusive cop who routinely beat and threatened kids. A total prick by all accounts.

One night a kid who he beat up threw a molotov cocktail on his front porch. The thing got out of control. Burnt the cop’s house down. Nobody hurt. (Am I suppose to put in the gratuitous “Thank God” here?)

What’s even better is the local cops totally fucked up the investigation. Arrests were never made.

And the best part! Everyone knows who the kid is.

Good for him!! We need these guys. They are our Clint Eastwoods.

Why? Because they are what keep them honest. You never know what kind of nut you are messing with.

I learned that in kindergarten for crissakes.

Just a reminder folks, Larry Lucchino is still a no good so and so.

Poor Larry. Remember how Larry use to always talk about his legacy? Like a President may do? It was bizarre.

Well Larry doesn’t do much of that now does he? He’s beginning to realize that nobody that matters gives a flying fuck about a world series yet they do care how their friends and their friends’ friends are treated and people in general.

Larry has failed on that by all accounts.

There was a good baseball book I read in the 80s called Dollar Sign on the Muscle.  It followed a year inside the Philadelphia Phillies scouting operation. It had the nice theme of the old guard coming up against the new. Old time scouts who played professional ball at some level v. new college boys with computers. Real Oscar and Felix stuff.

I remember one old timer who had to first see if the kid had a “baseball face” before he’d consider him.

In it there was a quote from someone with real cred describing what a “baseball man” is.

The first thing is he had to have played professional ball at some level. He then had to have reached a level he shouldn’t have but got there by brains and hard work.

Then he lives and dies with what goes on on the field and in the clubhouse. He does not care if there is nobody in the stands as long as baseball can be played.

John Tom and Larry should sell the Sox as soon as they can so we can remember as the guys who brought us two championships. But with every passing day it becomes clear that they will be remembered as rich goof balls Boston took advantage of.

We got their out of state $700 million which John Harrington is putting right back in Boston. They were such suckers that even Tom Reilly illegally held them up for another $100 million.

See guys, even our weakest player can out smart you.

And they boosted our confidence. A billionaire commodities trader, a Hollywood big shot, and Washington insider, fixer, get things done guy who also knows baseball better than anyone.

We can take what we need and if they don’t respect us abuse them just like anybody else from the outside. Make them leave here wishing they never heard of Boston. Regardless of the World Series Rings.

What a shame. Larry Tom and John seem to be universally hated in baseball (francona’a book makes that clear) and I don’t know too many people that like them around here. Think of all the people and things that have come and gone since then.

But not Eddie.

But Lynchy’s people can organize an GOTV on a dime. That’s what unions do. A GOTV doesn’t mean union members and their families. It means getting out everyone who probably will vote for him.

Can Markey match it? Yes he has some enthusiastic experienced people. Most were at Kate’s Christmas party.

But getting this group together when the leadership is weak can easily turn into a disaster. Especially in a quick campaign season.

The best thing I can predict about this race is that Lynch will get more votes in Markey’s congressional district than Markey will in his.

If an Irish or Italian or even Asian appointed people with the same DNA to these positions there would be hell to pay. And rightfully so.

A hundred years ago it was totally appropriate and the “right thing to do”. Not now.

Sal DiMasi appointing all Italians to his leadership team was cool because of the institution and it’s history of being run by Irish guys and Republican Yankees before them.

But that’s the exception that proves the rule for white guys. And it would be crazy for a white governor to make these appointments. The Globe would love it and call him a hero when everyone else would call him a limo liberal.  I would be very suspect.

But not when a black governor makes the appointment. To me he would be a dick if he didn’t.

Deval knows he’ll take heat for it. If it was easy everyone would do it. No siree. Deval did what a good non-wussy politician does.

Our society is inherently racist. Black guys get a raw deal.

People like Deval and Mo get it and the good politicians out there respect Deval for these choices. They understand the real meaning of the over-used term “giving back”.

To those liberal BMgers who have a problem with this appointment I suggest you talk to a seasoned Irish Catholic Boston politician. You know the type. The ones you guys label as racists because of what they look like and where they come from.

These people can explain why Deval is a good person for doing what he did.

Right now an on-line White House petition to fire Carmen Ortiz has more than the 25,000 signatures required for the President’s people to take a look at it.

This isn’t about Carmen Ortiz. She’s a political appointee who will be gone in a few years. Think about it. She’s in an office of career federal prosecutors and F.B.I agents.

Carmen got her teeth sharpened at the Middlesex County District Attorneys Office. The world champions of unreasonableness have been groomed there for years. Don’t get me started. (Not a knock against Gerry Leone, he’s a paradox. One of the most reasonable guys out there, but the Middlesex D.A.’s office’s reputation goes back decades, well before Gerry arrived on the scene)

The reversal in positions regarding former federal prosecutors serving as judges for Whitey Bulger related cases.

THis is just the stuff off the top of my head but there are many everyday things that do not make the paper that are also outrageous.

The questions needed to be answered are:

Has the Boston Office of the U.S. Attorneys Office and individuals within that office acted unethically and/or illegally by allowing political and other unethical factors weigh in it’s prosecutorial decisions?

And

Has that Office and individuals within that Office committed unethical and/or illegal acts in pursuit of these prosecutions?

Congressman Capuano and Lynch should call for congressional hearings, as should Senator Warren.

The White House should appoint an independent investigator with subpoena powers to investigate the Boston branch of the Justice Department for unethical overreaching and such things.

None of this Justice Department Office of Professional Responsibility crap.

Update David is right on with Chuck Turner.  Put a few c-notes in your palm and shake hands with Chuck Turner. WTF?

Once the people in Massachusetts are told whom to nominate they fall in line. After that it’s a matter  of money and big name celebrities.

If you don’t think the Whitey’s trial doesn’t stink more than the crap CharleyMTA took this morning than you probably didn’t know that the same assistant U.S. attorney that is fighting tooth and nail to keep Judge Richard Stearns on the case raised the same issue against the federal judge/former U.S. Attorney who was assigned the Kevin Weeks case.

It was a no brainer for the judge and he did exactly as the feds requested , he stepped down. No big deal. Nobody fought to keep him

Yet here they are working hard to keep this guy in.

Why won’t Judge Stearns recuse himself?

WTF is going on here?

An important rule of law was revisited and immediately affirmed thanks to the Dougan’s legal team.

You see, there is an ethics rule that a judge cannot receive personal benefit from attorneys or their firm that regularly practice before them. In this case Foley Hoag.

First off, Foley Hoag lawyers are in the BMC once every ten years. Easy recusal if they happen to draw Judge Dougan that day. Autiomatic recusal. In fact if Dougan paid them it would still be a recusal.

Now lets compare this to the SJC and the pro-bono work done by Paul Ware and his huge white shoes law firm. That firm gave the SJC a gift wrapped and with a bow when it was asked to look into probation and bring back a report that kisses the justices asses.

They did the same with the Cinquigrana Report.

But the Ware report and many aspects of it show ethics violations by many judges and former judges.

In fact I filed a written complaint with the Judicial Conduct Commission last year. (Anonymous complaint allowed per the rules- signed Ernie Boch, III, no relation)

The quotes in the Globe by Judge Mulligan and the blatant conflicts, including Judge Mulligan promoting JUdge Botsford’s nephew the day before she cast the deciding vote in his re-appointment as CJAM are far more egregious than Dougan getting help with this bullshit. In fact the judges should have paid for it out of their funds. The Dougan case was about each and every one of them.

But because the Globe is a Dan Conley Toady too it goes after Dougan,

JUdge Dougan’s ethics regarding legal representation cannot be separated from the real and concrete ethics violations committed by the SJC and some big law firms.

P.S. Dougan being represented personally and the SJC being represented as a body is a red herring.

Matt Connolly was a Norfolk County assistant d.a. doing major stuff back when Whitey was “the man”. He worked months on investigations only to be unknowingly thwarted by the F.B.I. Mostly by Whitey and Steve Flemmi’s handler John Connolly. (no relation)

Connolly attended John Connolly’s trial for purposes unrelated to John Connolly’s guilt or innocence. But as each pathetic witness strolled in and spun yarns that were hard to believe Matt Connolly slowly began to, and is still in the process, of an epiphany on everything related to John Connolly, Whitey Bulger, and Bill Bulger.

Tomorrow (Monday) Bulger’s lawyers argue to a federal appeals court that Judge Richard Stearns should recuse himself because of his strong professional and personal ties to prospective witnesses.

If this was Roxbury District Court it would be a lay up for the Judge. “Send it to the other session,” is the routine answer for many a conflicts that arise when Judges previously practiced in the same courts and with many os the same people now coming before him.

The feds and the media are methodically and rightfully made out to be fools by an experienced trial attorney most days of the week and there isn’t a damn thing they can do about it.

So my friends, when you read the stories in the newspaper and listen to David “Unbiased” Boeri’s report on the proceedings please do not form an opinion until you read Matt Connolly’s report.

Otherwise it’s like writing about the entire Patriots game having only watched when the offense was on the field.

Run a campaign like Markey did in his first congressional win. Attack the establishment and people like Markey who are part of it and demand that others fall in line.

The primary is a microcosm of that. The party and entrenched politicians demanding the proletariat vote their approved candidate. One that won’t make waves. Won’t rock the boat.

So I’m just saying to all the Vickie Kennedy surrogates out there you may not want what you wish for.

The hundreds of phone calls from certain people to other certain people around the state and country won’t be done for her like the public perceives.

A call from Ted Kennedy to the mayor of Fitchburg and another to a schmoe in Springfield who can bring out 300 votes is what gets Kennedys elected to the Senate. Not to mention the phone banks done by actual Kennedys.

There are so many factors and that’s just one.

But if Markey gets Vickie one-on-one my money’s on Eddie.

p.s. I like how Fast Eddie jumped in first. Other congressmen getting in the race dilutes it to Vikki’s benefit.

Liz Warren lived and worked in the State and because of her willingness to be the public face of fighting the corporate/financial man  she had legitimate credentials and a national reputation.

Her biggest problem with us locals was that Washington told us that she would be the Democratic nominee. People resent that.

Teddy, Jr has much less than Liz Warren had to offer yet more of the resentment. Remember, “it’s the people’s seat”.

Too many people will already have had their minds made up before the primary about Jr. and unlikely to change before the election.

Really, who the hell does this kid think he is? In this particular race that message would have legs.

Perhaps being told that if his name was Edward Moore rather than Edward Kennedy his candidacy “would be a joke” would gain traction this time around? After 50 years it’s timely.

Only Scott won’t have to say it. Everyone else will. Including the surrogates for Jr.’s Democratic primary challengers.

What’s to stop Michael Capuano or Stephen Lynch from emasculating this kid? In a very nice way of course. But what or who is there to be afraid of? Who’s to stop it from happening?

Just because his ginger second cousin strolled into his congressional seat last month (whom I’m rooting for to succeed for what it’s worth) there is nothing to indicate that anything close to resembling that scenario will happen in a senate run.

The small margin needed to win, a persnickety  electorate, much stronger ground forces for Brown because it will be a special (if opponent is a Kennedy the number of volunteers will double) will require a candidate whose baggage is known and candidacy does not by definition create a national issue on its own.

The Kennedy kids, (Teddy’s off-spring) may be throwing this out there just to screw-up what chances Vicki has for anything related to this.

In fact now that I think of it I would bet on it.

Basically all the crap we have heard over the past few days regarding preventability is all crap.

So, all I’m saying is when advocating a position never present an argument or a solution for which the data clearly supports the opposite view and little evidence is found favoring your point of view.

It never helps the cause. Especially when the other side has money and voices to showcase and contradict the many fraudulent assertions and half-truths. Like the NRA

While thinking through the cast of characters that were in that race I had a eureka moment. It hit me. A revelation.

An explanation more like it. One that explained the easy sell of John Connolly as the fed’s fall guy for others’ misdeeds.

First Markey.

In the spring 1976 Congressman Torbert Macdonald, J.F.K.s Harvard roommate and the pride of Malden, dropped dead right before the nomination papers were due for September’s primary. Republican candidates were non-existnet at the time and it was accepted that who ever won the primary was the next congressman.

So out they all came. Every north shore state rep. senator, mayor, and ex-athlete. Also in the race was Macdonald’s top district aide, a guy by the name of Joe Croaken.

Let’s see, we had Kathy Reinstein’s late father Billy in the race, the legendary former mayor of Revere and state rep. Also had a  Lopresti originally from East Boston but living in Winthrop I think. his family owned the concession franchise at Logan Airport and his brother and father were senators. He later became a senator too)

Also had Rep. Bill Hogan and Mayor McCarthy from Everett, a Donovan from Chelsea, and McGrail from Wakefield. And lets not forget the legendary Everett High and Harvard Football great Bobby Leo. He also threw his hat in the ring.

There were more of course and I am straining to remember. There were some Medford candidates, but no McGlynns.

Anyway Markey was in it too. He had two things that separated him from the pack. He was pro-abortion and he had the greatest tv ad in the history of MA politics. I’m sure you’ve all heard it told before, “They can tell me where to sit, but they can’t tell me where to stand” commercial.

Look it up.

Sooo here’s where I started to see the John Connolly connection.

If we could find a photo of these candidates at a debate or something I think it would explain alot.

Yes ladies and gentlemen, it is a south shore north shore thing.

Look at the names I mentioned. Two Italians and the rest mostly Irish, except Reinstein. BTW, just like O.J. Simpson people, Reinstein was not a Jew. German or something. But who cared, the guy was all Revere.

Okay, Okay, my point.

The north shore people can be more guinea than you average Italian any day of the week.

The south shore people have no clue about Italians. Fucking South Boston only had the now closed I.A. (Italian American Club, although a restaurant, not a club) where you could get half decent pizza.

North shore habitants? They think everyone lives among the Italians. Let me tell you something there are more guys cruising up and down Route 1 with Irish surnames dressed and coiffed just like John Connolly.

Yup, this college educated South Bostonian took a ride through the tunnel for the first time and never looked back.

He was like the high school kid that never partied but when he got to college he suffered alcohol poisoning the first week.

First off the food. North shore cooking always blew the south shore away. Some of the best Italian cooks today are Irish Catholic girls from Saugus with attitudes that would put Schnookie to shame.

Sooo, when the feds needed to sacrifice one of their own to protect the herd Johnny Canoli came easy.

But the killings took the wind out of the sails and I’m going to let it be for now.

However, there is no need to avoid asking now why this young man was treated this way.

Why was this poor bastard, who the cops had minute evidence to believe he was anymore involved than having the bad luck of being related to the shooter, brought out on display by the government for no other reason than to portray him as an evil doer?

Really, you don’t believe that every time an agent and reporter got/get together for a mutual stroke fest the agent didn’t/doesn’t file a report with the home office “detailing” the meeting?

And you really couldn’t believe that every time a government controlled propaganda newspaper story unwittingly written by the self-absorbed reporter is published a newspaper clipping of the story wasn’t sent to update the file?

How else does a federal agent let the bosses know he is doing a good job?

It’s even better for long time Bulger reporter David Boeri. His brother Steven is a DEA agent who was assigned to help plant bugs on the white man’s American made car back in the day.

Boeri’s brother was among a few involved that Bulger made to look the fools when the bug was found before it ever rolled.

Yeah, this is the guy our local public radio station assigns to do in-depth coverage of the hurry-up-and-get-it-done-and-protect-the-cover-up trial against a man who hurt his brother. The one that opened his question at the Whitey capture press conference saluting the feds with a “congratulations”.

What do you think of all this Dan Kennedy?

However, the jury also knows that if they follow the letter of the law than any elected official with a budget and discretion can be found guilty at anytime for allowing political influences to affect expenditures. Hiring decisions alone could get a guy life with “on and after” years.

The law, passed in haste last year as a knee jerk reaction to Sal DiMasi coupled with the unbending rule of not slowing down the casino bill, is vague and overly broad. A Cahill conviction could be vacated on appeal.

As that’s going on Carmen Ortiz has been zealously investigating legislators from both branches for recommending jobs for people who may have or may not have donated to their campaigns.

Based on legal fees reported in campaign finance reports and other indicators it is widely believed that Senate President Murray and Speaker Deleo’s lawyers are fighting hard to keep them from being indicted. No secret there.

The probation investigation has been criticized for being a product of an unsavory symbiosis between the SJC, the Boston Globe, and ultimately the over ambitious yet incompetent U.S. attorney Carmen Ortiz.

Former U.S. attorney and moderate Republican governor Bill Weld came out swinging calling both the Cahill and probation indictments/investigations chicken shit at best.

Wouldn’t Weld be a great candidate for governor next go around? Have you seen who the governor of California is lately? Talk about a time warp.

Meanwhile today’s daily dose from Matt Connolly’s Whitey Bulger’s trial blog brought up yet another of too many smelly things going on during the pre-trial farce happening at the Moakley Courthouse.

Four days to impanel a jury? Judge Richard “Friendly” Stearns’ change of mind regarding issues of law and fact resulting in the credibility of his former colleagues not coming into question?

As this is happening our governor, the former high-up in the U.S. Justice Department and widely speculated to be the next United States Attorney General, makes sure he gets Terry Murray and Bob DeLeo (see above) alone in a room (he cleared out the few aides who also attend the weekly private meetings) and more or less asked them to consider getting on board the gubernatorial campaign ship for U.S. Attorney Carmen Ortiz (see above).

That’s Boardwalk Empire script stuff.

Couldn’t what Deval did be construed as him acting as Carmen Ortiz’s bagman?

(“You know, the U.S. Attorney Office’s in Boston is under staffed. Too many files and too few soldiers. So its only natural for resources to be allocated away from friends.Anyway, she’s OK with me and I think you both would be doing yourselves a favor if you had a sit down with her.”)

Seriously. Keep the facts as is and change the names to Speaker Jay Kaufman, Senate President Jamie Eldridge, Governor Steve Lynch and U.S. Attorney Jack Hart.

I would love to see what the Globe would do with a cast of characters like that.

Add in the well known facts that on top of potential A.G. job, Deval and the President are Chicago buds, the national Dems and national party have been choosing our candidates as of late, the Globe has been touting her, and she was appointed by the Prez to her current post.

Meanwhile, the anointed Carmen Ortiz is trying to convince a federal magistrate to imagine with her and believe that a motel owner in Tewksbury is a bad man and his mortgage free three million dollar piece of property should be hers, I mean the government’s.

And Carmen proudly announces today that her office leads the country in civil forfeiture.

Any bells going off here people? Like Annie Dookhan type bells.

Is the U.S. Attorney waiting for the Cahill verdict before deciding who else, if anyone, will be indicted and for which crimes?

Has the U.S. Attorney found herself cornered legally and politically? (although politics shouldn’t play a part in her office) Many legal experts are telling her the cases she is trying to make out of the Boston Globe’s  Pulitzer Prize winning piece of propaganda aimed toward aiding the SJC in taking over the Probation Department and the jobs that go with it won’t work.

Well actually she isn’t cornered legally. She doesn’t have to indict. No big deal. Happens everyday. Nothing bad about it. Part of the job. Another day at the office. Part of the daily grind.

So it must be political. And it could backfire and kill her chances for the corner office. That’s not good.

Why?

Because the President and the Globe want her to be our next governor. That’s why?

So really, with all this going on and with his background and experience what the fuck was Deval thinking when he launched this stun grenade at the super “private” meeting with Murray and DeLeo?

Deval Patrick seeks endorsement for U.S. Attorney Carmen Ortiz From Senate President Murray and House Speaker DeLeo

Why? Well here the first paragraph of the Globe’s story:

In a recent private meeting, the House speaker and Senate president were stunned when Governor Deval Patrick – according to a person briefed on the conversation – raised the prospect of US Attorney Carmen Ortiz running for governor and spoke favorably of the prosecutor whose probation investigation has rattled the Legislature. According to the person, Patrick said the federal prosecutor had a great story to tell about her successful legal career and left the impression he was suggesting the two should meet her.

Allow me to put this in perspective. Suppose my buddy Dan Conley started investigating some Boston city councillors. Who knows what for, but a grand jury is involved and it’s all over the papers and indictments are expected any day.

Now suppose that during the time the councillors are sweating it out as they go along with their routines out of the blue the mayor says to the two presumably about to be indicted by Conley, “Hey, Dan Conley’s not a bad fella and would be a good candidate to succeed me. You two really should sit down with him.”

As bad as that sounds add to it that, for argument sake, the mayor and Conley are buddies and travel in the same social/political circles.

That is what Deval did to Terry Murray and Bob DeLeo in their weekly private meeting?

But I guess that’s Ok.

Deval needs to explain himself on this.  Many questions need to be addressed.

What communication has he had with Carmen Ortiz about her campaign?

What communication has he had with Carmen Ortiz about Terry Murray and Bob DeLeo.

Same questions asked  concerning surrogates and the White House, including the big guy.

We all know the case they are pursuing is shit. In their panic have they blindly backed themselves into corruption of justice charges?

Perhaps Deval did?

I don’t know but there needs to be a congressional hearing or two and perhaps a special investigator. With subpoena powers.

Hey Steve Lynch you’re the guy that can do this.

The case to suggest nefarious conduct on the part of our governor and U.S. Attorney is much stronger than the ones being made against Tim Cahill, Jack O’Brien, and any of the other poor bastards caught up in that farce.

Turns our Bob is a retired postal worker from Randolph who asked me legitimate questions re: the Inspector General outrageous power grab and I went all Ernie on him.

Yesterday Bob pointed out what a wuss I am for hiding behind anonymity well he puts his name out there front and center. He then added the Randolph and postal worker part.

Quick reminder on legislative procedure. The legislature is out of session until next year. There are no more hearings, no more anything. Anything brought before the House can be stopped by one vote.

Things do get done. Less important things like a bridge naming.

Supplemental budgets also must get done. They’re always needed to keep things going until new legislature get down to business the first of the year. Because one vote can stop it from going forward they are usually benign and done with consent of Republicans. These are “informal sessions” as opposed to “formal sessions”.

You see? J. Edgar Cunha, the head of the agency that is tasked with shining light on government is playing cutezie the tenth degree. Sneak in a budget amendment giving him the most powerful legal tool available.

One given only after thoughtful deliberations and debate. After decision makers (reps, seantors, and governor) are given an opportunity to digest the relevant information after it is collected and public hearings are held.

Yet this door knob named Cunha thinks he can scare our elected officials into blindly submitting to his wishes because of what? Howie Carr? The Globe? I don’t know.

But really, this guy needs to be sent packing.

David  Boeri of WBUR is in my honest opinion a “journalist’s” “journalist”.

Keep it up David. You’re proving points many people have been trying to make for years.

The evidence showed the feds have real estate experts searching for property with no mortgage or a low one. They then try to build a case to seize it. This case is beyond ridiculous.

Attorney Matt Connelly mentioned this case on his Whitey Bulger blog in the context of the media coverage it has received. Practically none. Does that make sense? Think about it? We know all there is to know about the poor woman with the bad driving history who was this week’s flavor or the month.

And the unfortunate bastard who caused the Green Line rear-ender today will be put on a plate for us to carve into very shortly.

But this flagrant and well documented prosecutorial abuse goes under the media radar. Especially by the Boston Globe.

Why? This case should be the coffee talk. Carmen Ortiz should own this. It’s scary stuff.

Connolly has shown many halve truths, false innuendoes, and at best naive interpretations of facts reported by the Globe over the years that play the precise tune the boys with federal badges like to hear.

Talk about wink wink nod nod. Could historians find files many years from now that document a relationship that would destroy the Globe’s self-written image of purity and integrity?

I don’t know. But Connolly has me thinking. Big time!

Remember a few months ago a Globe columnists was secretly suspended for supposedly plagiarizing a blogger on an benign editorial? It sounded fishy then, but hey, who am I to question what the Globe does? That’s not my thing, right?

Didn’t this same columnists pen a well written piece a few weeks prior criticizing Judge Richard Stearns decision to stay on the Bulger case? (This is one of many strange pre-trial goings on that Connolly questions)

Do I see set-up?  Were the bosses sending a message? Did they have a choice? The devil always wants more, right? Am I delusional?

Jesus Christ I’m starting to scare myself. Does this sound like the stuff heard outside the Lindemann Center before it opens in the morning?

By promoting non-stories into stories and non-scandals into scandals on a state level and ignoring and not covering significant local stories occurring at the federal level is the Globe and other local media controlled de facto by the federal government?

So “Contracts Don’t Apply to Me” Howie Carr pointed out today what is pretty much universally agreed upon: Martha Coakley is wrongfully prosecuting Tim Cahill. He did nothing criminally wrong.

But Howie pisses on Tim for his run for governor which may have cost his man Baker the corner office.

So Howie being Howie ends his non-endorsement endorsement of Cahill with

I’m sure he’s hired a shit load of Everett kids over the years and is the first with a check for something needed.

Think of it. He treats Everett like family. And who wants to work with their family? Especially if the family is Everett. (You all know I hate Everett, right?)

Check out the picture on the front page of today’s Globe. I thought for sure they had found another Whitely related body somewhere next to Dorchester Bay. The big black SUVs with darkened windows and a bunch of white guys in suits standing around. Where’s the tent to conceal the digging?

Personally I think Everett’s a better location and will be easier to get done from a political perspective. Don’t believe me? Then check out Joan Vennoci’s column today on the trouble Eastie types have caused Logan Airport over the last 40 years and some of these people are now gunning to stop the casino.

The Everett location is better for many reasons including location, neighborhood impact, interstate highway access, bus, subway,commuter line, and water transport, and  less neighborhood objection.

It’s alos a better location for a nearby soccer stadium which now seems to be in play for both sites. The O’Donnell group recently floated building a much need soccer stadium at the old Wonderland Dog Track with an approximate seating capacity of thirty thousand.

I think this move may have changed things a little and I would not be surprised if that got Bob and Jonathan Kraft attention and on the phone to Steve Winn. There is a site in Somerville closer to the proposed Everett site than Wonderland is to Suffolk on which the Krafts have wanted to build a similar stadium for years.

After all they do own the local professional soccer team which currently plays in Foxboro. Yet most soccer fans are immigrants and there is a real concentration of them and their off-spring close to Boston.

All this must have O’Donnell worried. He knows Everett. Let’s just say the city has a history of playing ball. If you know what I mean.

Now the Suffolk Downs site has a spanking new Revere Police station right outside the gate. These guys are salivating  over the details and paid overtime not to mention the opportunities for the less than holy law enforcement types to make some cash from or inflict some beatings on out of town gambers.

They also built a brand new bridge to Chelsea so the drug dealers and prostitutes will have better access to clients.

Everett doesn’t need the bridge. And the Everett police. I doubt anyone here remembers King Arthurs. Way way back an off -duty cop was shit-faced in the King Arthur’s strip club in Chelsea. I’m not sure if he got thrown out or had some lip with one of the wise guys there, but anyway the Everett cop was typical and called out his on-duty Everett cops to come to Chelsea and fight his fight.

They were more than willing and came right over. They then busted into a motel room (only the best strip clubs have on-site motels) and beat to death a made wise guy. Cost the city millions and a few guys went to jail.

Ahhh, Everett.

The sub-title of his blog is “A Former Prosecutor’s View and Analysis of the Whitey Bulger Trial, his Life, and the F.B.I.”

He’s written a book on John Connolly (no relation I believe) and makes the case that he is a pawn used by the feds to keep their house of cards from falling.  He is writing another on Whitey’s trial and his daily blog posts are part of that work.

Based on the facts he presents (many times with links) we get a much different view than the narrative we have been spoon fed over many years.

With the information and contrary opinion (Deborah Hussey’s brother is not the only opinion fellas) so easily accessible  it’s inconceivable for anyone in the media to discuss or write about the case without an understanding of Matt Connolly’s point of view and the facts he relies on in support.

Among the many issues reported and chronicled on the site are the selected facts and misinterpretations continuously reported, especially by the Globe and the books penned by its reporters. Connolly shows the quid-pro-quo between the feds and the Globe and the mutual benefits each received by unethically and in some cases immorally deceiving the public in my opinion.

This is one of many questions raised by Connolly, but the one playing out now is the rush to try Bulger and the absolute abuse of process getting us there. One of Connolly’s best points as he questions seriously flawed pre-trial rulings is that no U.S. Appeals Court will flip anything from a Whitey Bulger conviction.

Yeah, I’ve always known appeals courts are result oriented, but this statement added with the abuses in prosecution, the illegal doings of federal investigators, and unethical line crossings of the judicial and executive has me in a funk.

It’s like why bother? They just laugh at us. All of us. The people driving to and from work everyday to their non-powerful jobs. And nobody has power like they do. These guys are 21st century Masters of the Universe because they know they can pick a name out of the telephone book and seriously mess up some lives.

It seems this ilk is prevailing in the Justice Department. Perhaps even some in the federal judiciary are subconsciously afraid of provoking the wrath of our federal police?

The John Connolly situation is gut wrenching. To know what is going on in Florida with his murder case would make you throw-up. Thanks to Matt Connolly I’m aware of it and will make BMGers aware of it in the future.

The rush is to put this all behind them without the shit really hitting the fan. The more people have time to think about it and the more the Matt Connolly’s of the world will make sense.

Sooo all you wannabe Woodward and Bernsteins out there this is the place to be. Corruption in the federal government. That’s what Watergate was and it started with a simple break-in. This is just murder.

But the cover-up my friends. The cover-up.

Who will expose this? The Globe? Of course not, they’re in on it whether they know it or not.

But then most journalists today believe making a name for themselves is finding a low hanging fruit poor schmoe and beating him or her until no breath is heard.

Just like the feds want it. Keep eyes away from them.

Sorry to tell all you journalists this, but it takes hard work to get real stories. Getting off you ass and coming up with something. And sticking to it.No one is going to hand it to you.

You know what I suggest you do? Go home and rent All the President’s Men on your Net Flix or HuLu or Telemundo, I don’t care. Watch it and see how many dead ends they hit before finding pay dirt.

Currently Tom Menino is due for re-election next November if he wants to start another term in January.

This time around there is a much stronger than usual battle for the council presidency that will be voted on the beginning of the year.

Hmmmm, so are these statesman making the case to fellow members for their support counting on Mayor Menino resigning or dying?

My money is on them banking on his death rather than the former. I mean he’s freakin Tom Menino. He ain’t resigning.

The guy just spent a spring trainings worth of time in the hospital and nobody believes he’s even considering kissing the job goodbye before the term ends.

So, what cold hearted a-holes, really.

Hey dudes, I can’t remember the last person taken out of Spaulding Rehab with the sheet over the face. You know what I mean?

The guy’s coming back and he knows what each and everyone of you has been up to. That sucks for you.

Even if the mayor decides not to seek another term you can be sure he will put road blocks in your election possibilities as much he can. After all he will still be the mayor during the election.

BTW, on the same subject, how about the Globe’s Kevin Cullen’s that’s-the-best-you-can-do column today on Suffolk District Attorney Dan “Search and Avoid” Conley? Obviously the Globe’s way of keeping Conley’s name in the mix for mayor as the talk ramps up.

So what did Cullen write about as an example of what a great person/district attorney/public servant Conley is?

The fact that Little Man Dan is not standing in the way of a pardon for two old time gangsters wrongfully convicted of murder because the feds lied to protect the real murderers. They spent years and years in the can for this. They were eventually exonerated.

Cullen’s making Conley look good by just showing up. That’s my point. The best Cullen could find on him.

The guy is a danger in his current capacity. I can go through a list of things I’ve written before on his actions and inactions.

Yeah, yeah, yeah, I bet most of you MA political experts who come from other parts of the country and now think you own the place never heard of “The Earl of Worcester”. (I just made that up, you like?)

Early served almost twenty years in Congress kicking ass on three fronts; constituent services for the most downtrodden in central MA, bringing home the bacon for his district, and as chairman of the House Appropriations Committee steering money to many causes that needed a powerful voice.

There is a reason U-Mass Med is in Worcester and one of the finest medical schools in the country. It’s Joe Early. On the national front the fight against cystic fibrosis received research dollars to a degree that had previously been lacking.

Early came from the great great city of Worcester. He could play basketball so naturally he ended up at Holy Cross, a basketball powerhouse at the time. (Right central-mass-dad?) He was on the 1954 team that won the National Invitational Tournament (NIT). At the time that was the prize.  Not the NCAA.

But really, who cares he was a jock? The guy was all about doing his job well by doing the right thing for his constituents, his district, and the country. He worked tirelessly while never missing an opportunity to hit the track. Not uncommon to see him with his face buried in a Racing Form on a Friday or Saturday afternoon at Suffolk.

As much as he was devoted to the job he was equally shy of publicity. He pretty much disdained it. Think a bizarro world John Kerry or Ed Markey. Early got things done without running to the press or putting on airs. He was Worcester through and through.

Worcester, one of the greatest cities in the western hemisphere. One of three cities of seven hills. Rome of course is one, but can anyone name the third? Bueller? Bueller? That’s right. Cincinnati.

A guy from Cincinnati told me that.

Anyway Worcester has produced more than a few boatloads of good people who became successful and Early was one of them. A real melting pot where a city kid like him could pay attention and get a solid education in life so when certain opportunities came he was there to take advantage.

Like many good men Early’s professional career ended when a “scandal” became the flavor of the week in 1992.

Up until that time congressman could draw from their pay check at the beginning of each month even though the books didn’t say they were paid until the end of the month. It was called a draw. Or something like that. I don’t won’t to sugarcoat it because at worst it was still harmless. It may have been considered an overdraft and they charged a fee. I’m not sure.

Early was a product of the Depression and World War II and had seven kids. You’re damn right he took advantage of this. Fuck yeah! Tuitions, mortgages, the track.

So in 1992 wise people used this “perk” to politically kill a few key people standing in their way. Down went Early as the pretty boys in the House squirmed and left him hanging.

Early took the House floor during the height of the controversy and accused most of his colleagues of being the weak kneed Ken dolls they were.

“They ran like rats!” was his infamous yell from the House floor to members describing the actions of his congressional colleagues when this meaningless and blatantly politically driven non-scandal-scandal was all over the news and late night monologues.

The upcoming election was the first after a major redistricting. Early’s district now snaked from Worcester down to Fall River. And the Republicans put up state rep Peter Blute to challenge Early.

Early beat Blute in Fall River and the new parts of the district but couldn’t fight him back in Worcester and central Mass. Blute won but missed out on the Congressional pension when a former Joe Moakley aide named Jim McGovern took him out four years later.

It’s a shame that most people like Joe Early couldn’t get elected today. They’re too honest.

It asks what many civil rights advocates want answered and gives evidence of the longtime and still on-going reputation assassination of former Senate President William Bulger and the Justice Departments’s bizarre desire to indict him for any crime they can no matter how petty and unclear.

Don’t think so? How about the criminal enterprise the feds allege was being run by a threesome in the Probation Department? You know? The ones that never took a dime. At most they violated in-house hiring policies but the feds went all law school exam on the facts and created a racketeering ring out of Jack O’Brien and two of his bobos.

Don’t be fooled thinking it’s about Whitey. It’s not. He’s just another gangster, the second oldest profession. It’s about the way the Justice Department is run and whose interests trump whose.

BTW, if not for the Globe would Whitey have the mystique and reputation he’s garnered over the years? I highly doubt it.

Long after Sacco and Vanzetti were fried on the electric chair on the site where Bunker Hill Community College now stands legal scholars were able to take a look at the whole kit and kaboodle away from all the noise occurring during the time of the trial.

It didn’t take much for the constitutional types to realize that the system railroaded these guys. It failed completely because of public pressure and misconceptions. The trial at the time was world wide news and everyone wanted to be on the right side of the day not the right side of history.

There were improprieties through and through. Books have been written about the case that symbolizes a system gone bad.

So bad that in the 1980s Governor Dukakis declared through state proclamation that the system failed these two men and they did not get a fair trial. The case is as much a black mark on our home as is forced busing.

Sacco and Vanzetti were convicted of holding-up a payroll truck heading to a shoe factory I believe, in Braintree. The guard was shot and killed. The robbers got away.

The word had always been that one was probably there and and other had nothing to do with it. The scholars pretty much say the same.

I remind you of these two as a forward to the strong suggestion BMGers and others interested in the upcoming Bulger trial follow Matthew Connolly’s blog The Trial of Whitey Bulger.

Connolly is a retired Norfolk County prosecutor and criminal defense attorney. He gets it. He knows the facts. He knows the details. His research is non-stop. And he has nothing but time. (Remember, he’s “retired”)

He’s already written one book on John Connolly and is writing one on the trial.

He blogs most days and provides the history and facts of the many aspects of the case and relates it to the law. He raises serious questions that counter the narrative the FBI, U.S. Attorney, and the media (especially the Globe) want the citizenry to believe.

As a cherry on top he shines light on the sleazy ways the Globe and it’s reporters have covered Whitey and Billy over the years.

But what he really does is show how the system is rigged to protect the nerds in the Moakley Building and the Justice Department who have little dicks but extremely powerful jobs (that’s me with the low brow attack. Connolly is highly respectful and professional in his writings.)

He should be a must read for law students, prosecutors, defense attorneys, constitutional scholars, and fucking Americans.

This guy Connolly is a godsend. My rantings can’t come close to the depth of information and explanation he offers everyday. Now I have a place to go and get material to bitch and moan about.

As said before I think Steve Lynch can run the right campaign and walk away with the Senate race. Get all those Brown independent and Dem voters to the polls on primary and when the polls close start setting up the Bud Lights (T.M.) at the Iron Workers Hall.

Why do I want this you ask? Well what could be better than watching Mike Capuano lose his shit as he sees his campaign going down to “Steeeve Lyench”. Capuano looks so down on him.

Remember when Scot Lehigh tried to suggest that Lynch may be wrapped too tight because he voted against the health care bill. Hmm, that column had Capuano stink all over it.

Watching Capuano get pissed off would make me laugh. And after all, isn’t that what life is all about?

Lynch won’t have the full support of the unions. But he will have the members, a good portion of their families, and a significant number of people who voted for either Brown or Warren.

Lynch knows how to organize as well as anyone.

Scott Brown, or anyone else the Repubs put up will go down and go down hard against him.

On the flip side Rich Tisie IMO could beat a liberal dem for the Senate. The anti Tea Party Republican.

Different Dynamics in play than when Ted Kennedy died. Deval appoints himself to vacant spot. Repubs bitch and moan. For the most part Democrats would welcome it. Capuano may take him on in the special but doubtful if he would get traction.

Then comes the dysfunctional family we call the state GOP. Scott Brown won’t have the support within the GOP to walk away with nomination. Not saying he won’t get it just saying it won’t be smooth.

The story he tells of a doctor’s comment after his beautiful and thriving daughter was born is chilling. This is what happens when people are expendable.

If you don’t think the report is a piece of garbage than you must ask yourself: Why are they releasing it the Thursday before the big election? Not to mention the hurricane shutting down NYC?

The report is all about statistics and more statistics, naturally resulting in half-ass conclusions and worse, recommendations to even further chip away at the Bill of Rights and the Mass Declaration of Rights.

Cinquegrana was tasked by the SJC to

determine the rate of acquittal in jury-waived trials on charges of operating under the influence (“OUI”) of drugs or alcohol, and to examine whether that rate differs from the national average and from the rate of acquittal in other criminal cases in Massachusetts.

So that’s what he did. They guy hadn’t a clue what to do. Not his fault, the SJC hadn’t a clue either. But the Globe ran a Spotlight series so the Court’s hands were tied.

Cries of “There may be a Pulitzer in this for our friends at the Globe” were heard coming from the Adams Courthouse.

An assignment more appropriate for a mid-level type at Bain Capital, Cinquegrana went out and got some high-priced statisticians to “volunteer” to do the work.

Freakin’ conflicts of interest all over the place. But the Canons of Ethics don’t apply to the SJC.

Imagine the Pope sinning all the time and in open. He can, he’s the Pope. Huh?

Anyhoo, there are some statistical disparities among the courts and judges on OUI bench trials.

Jurisprudence should run like a widget factory goddamnit. Screw the individuals. And screw the Constitution. We want efficiency so who cares about reasonable doubt?

All because one out of twenty OUI arrests result in a not guilty finding after a bench trial. (shouldn’ they have researched data on other crimes adjudicated in the district courts?

In a letter released with the report the SJC said there is the appearance that some judges are lenient. “Lenient” used as  pejorative I assume. The opposite should be worse, don’t you think?

I’d like to see a report on all the motherfuckers sitting on the bench handing out mean and nasty sentences and conditions of probation just because they can.

How about plea bargains that are shams resulting from judges severely punishing people for exercising their right to a trial. Different than a leaner sentence in return for the plea.

More like…”You can go to trial and hope the jury believes you and your buddy over the cop that beat the shit out of you and stole your money and is lying about the facts. If they don’t the judge is giving you significant jail time even though you don’t have a criminal record. OR you can lie and admit to it just as the cop says it happens, pay a fine, and go home.”

And in the district courts it’s the same abusive lying cops who are protected by some of these jerks in the robes.

But no, the SJC wants all finders of facts (judges and juries) to interpret reasonable doubt for all sets of facts in a more general way. How general? I’m not sure. You’ll have to ask the Globe. Or wait until the SJC asks them for all of us.

John Walsh did miracles two years ago when he convinced all the Democratic candidates to pool their lists. This resulted in the Dems’ targeted voters turning back the Tea Party surge.

Martha Coakley didn’t have benefit of other [statewide (see comments) -ed.] organizations. And neither does Elizabeth.

On the flip side Scott Brown has a fraction of the people helping him this time. He has a boat load of chiefs and big feeling stiffs who haven’t clue what to do on a an election day and few savvy mid-level types.

So what it all comes down to my friends, yeah, is everything’s gonna be fine fine fine. Cuz I got one hand in my pocket, and the other is working my balls off to get the vote out for Liz next Tuesday.

And in the mean time 99% of you have close friends and family members voting for Scott Brown or leaning towards him. Your mission is to convince at least one of them to switch their vote. I suggest the “scott’s a dickhead” approach rather than the “Liz is awesome” spiel.

Barnstable County District Attorney and man’s man Michael O’Keefe does his best Tokyo Rose with this gem.

“These are people who have been sentenced to state prison for drug distribution,” he said. “You don’t go to state prison in Massaschusetts unless you have a significant criminal history.”

Wait. What? So we don’t have mandatory sentences based on amount of drugs in possession?

Felonies, right? State time. Prior record is not an issue.

Hard to believe these dangerous characters don’t have violent charges and cases keeping them in the can.

Depending on the questionableness of the evidence that Dookan did the exam the defendant should be granted bail, including personal, until the case is figured out.

Not rocket science for the mills known as courts operating everyday throughout the state.

It will be bad. Real bad. Major players gonna have their names on indictments and the place will never be the same. Not sure what crimes if any have been broken but that doesn’t matter. When it comes to politicians it only has to fail the smell test to get the wanted result. A different standard of justice.

Anyway, get ready for Carmen Diaz and the Globe to take this probation piece of shit case and make it appear worse than Watergate as they prep her for the next governor’s race.

Question: Did Suffolk County Dan Conley pay someone to take the bar exam for him?

The reason I ask is the rash of correspondence going on between Dan, Judge Mulligan, and Judge Charles Johnson of the Boston Municipal Court. Also relevant are Conley’s quotes in the Globe recently that sounded much more like the rants of a crazy person hanging in front of Park Street Station than those of an educated person with such a serious and responsible position.

Rather than get into the esoteric points it should be said that those in legal community paying attention to this are positively outraged at Conley’s lack of respect for the courts and the system. His behavior goes beyond bizarre raising questions of competency and temperament.

The dispute arises from the drug testing mess. For some reason Dan does not get the basic legal tenet of habeas corpus and the effect tainted scientific evidence has on the reasonable doubt standard.

Dan is insulted that the United States Constitution and the Bill of Rights takes precedent over his unethical and unprofessional rants. Not to mention his ethical duties regarding the tainted evidence on which his office based convictions.

Basic concepts that Little Man Dan can’t get.

“He who yells loudest wins.”

Right now Scott is yelling loudest.

And at this point in this race another truism comes into play.

“People only remember the bad stuff.”

Time for Liz to make sure the undecided and some current Brown voters see the other Scott Brown.

The one that puts Scott Brown first and the Massachusetts people last.

After getting elected to Senate he immediately cashed in. Slimy rapid ascent in National Guard and sudden close relationship with top general. Conflicts of interest all over the place. Both using Guard and US Senate unethically.

How about Scott’s phony war deployment? And his medal for giving a speech. There are many real war veterans and medal recipients out there who are appalled with Scott.

The Warren campaign has more on him and they have people that can put together an effective series of ads casting doubt on Scott’s man of the people persona.

The most important thing is to run the ads everywhere over and over again. He who yells loudest, remember?

Yes throw in the positive ads. But Warren has smart creative ad people on the payroll. The order should go out from the top. Get the truth out to everyone within the next two weeks.

The quintessential Rudy move.

The high-brow problem, unlike the Rudy one, concerns congressional ethics and perhaps justice department stuff.

Basically Scott was just a regular JAG officer in the reserve. Nothing wrong with that but certainly nothing special. When the Guard realized one their own was in the Senate and on the Armed Services Committee they immediately started the foreplay.

Scott then gets a questionable promotion and a probably undeserved medal for giving a speech along with all sorts of goodies.

In the past two years, the senator has also won a much-coveted promotion to colonel, one notch below general.

He secured it after a surprising transfer to the Maryland National Guard. Veteran ­observers of the Maryland Guard say it is the first time the state’s main judge advocate general corps, the military’s equivalent of a law firm, has had four colonels attached to it. Military manning documents authorize it for one.

Brow began working out of the ­Pentagon, as assistant to the chief legal counsel for the ­National Guard Bureau, serving in the same office complex as the top general overseeing the Guard. These are the same people and the same agency Brown helps oversee as the ranking member, or top Republican, on the Senate Armed Services subcommittee with jurisdiction over the National Guard.

See what I mean? Can a state legislator do this? I don’t think so. Doesn’t this violate Senate Ethics? How about military ethics? How about criminal laws? Compare this to the allegations made in the Probation scandal. How does it compare to Tim Cahill running lottery ads? Don’t theft of honest service laws come into play here.

Everything in Scott’s military record is dubious since his election the the Senate.

Can we trust that Scott is committed to the people of Massachusetts first?

For ease of communication, a spokeswoman said, the Pentagon office in which he works is near that of General Frank Grass, who oversees the National Guard and serves on the Joint Chiefs of Staff.

On July 19, Grass was called to testify before the Senate Armed Services Committee ­because he needed to be promoted from lieutenant general to four-star general, the rank assigned to the head of the ­National Guard Bureau.

During that hearing, Brown, as senator, lobbied against possible cuts in pay that he, as a Guardsman, receives.

“I would just ask you to look long and hard at that because … I think [it] will be a deterrent for our Guard and Reserve to serve,” Brown told Grass and two other generals also awaiting promotion. “So, I just want you to be aware of that. It is something I am aware of, and I would ask you to take a look at it.”

The senator concluded his statement by saying, “I look forward to being honored to vote for all of you.”

A week later, Grass moved up in rank as the Senate gave unanimous consent to a bevy of promotions. Among the more than 800 other officers also getting promoted in the same vote was Brown himself.

Hey John Tierney, can you show us where in the court transcript the federal judge said you had “nothing to do with it”,

Frankly I have never heard os such a thing; a judge pointing to a non-party and saying they were not involved. Preposterous! Perhaps the judge did say it. Maybe I’m wrong. but I doubt it. If anything Tierney is taking a quote from the judge and twisting it.

As an attorney Tierney may be in violation a few ethic rules by purposely lying about a judges statements in a courtroom. Especially in the manner Tierney has chosen. A BBO complaint perhaps?

I wish I had time to tell you about the tiff going on between little boy light weight district attorney “Search and Avoid” Dan Conley and Boston Municipal Court Justice Charles Johnson.

Conley went all third grade on Johnson in the newspapers because he was unhappy with the logistics of getting the Anne Dookhan cases to court in a timely manner.

Well, after reading Conley’s personal attacks against him Judge Johnson penned a kick-ass, well written, respectful letter to Conley which was sort of like but not exactly like the letter that stats out with…

“Dear Joe,

as a good friend I though I should let you know that a crazy person has gotten a hold of your stationary. My goodness, this person could be a reputation ruiner if it continues. The letter I received today would be quite embarrassing for you had I not known this garbage could not have been penned by a gentleman with the fine intellect you possess. blah blah.”

Now that Scott’s made campaign managers an issue it’s time to bring Eric Fehrnstrom’s name and reputation to the front lines. Why would Scott rely so heavily on a person that proudly conducts his professional life like an A-1 amoral, unethical, repulsive, loathsome, malicious, depraved and vile scumbag?

Voters should be reading and hearing more and more about Eric “See You in Hell” Fehrnstrom and how he operates. He’s an intriguing guy who voters could find fascinating and therefore pay attention to the stories. Karl Rove is boring. Eric is not.

Who is this guy? He’s the puppeteer of Mitt and Scott. People need to know.

Decent people will take Doug Rubin over See-you-in-hell Fehrnstrom any day.

Is it me or does Scott seemed rushed and a little annoyed when answering questions in the debate? It’s true for interviews which have follow-up questions and follow-ups to follow-ups. You know, like an interview.

That is the setting that needs to be forced on Scott. Get him to explain himself beyond the soundbites. He doesn’t like it and it shows.

Still waiting for the Jack Cinquegrana report the SJC commissioned almost a year ago. You remember? Another quid pro quo between our high court justices and  the New York Times’ Sulzberger family in return for the jobs they gained by rubbing out Jack O’Brien at Probation.

The next Spotlite series soon after the Probation/Jack O’Brien series was a Fourth of July like fireworks display about a dog (not a pit bull) biting a man. The liberal Globe was upset that out of every 20 people arrested for drunk driver one eventually ends up being  found not guilty by a judge. One in twenty. Five percent. Sounds about right. Especially in a country with a “beyond reasonable doubt” standard.

Like all Spotlite series the first story appeared on a Sunday. And just like the Probation stories the SJC appointed a special investigator with subpoena powers  on Monday. WTF?

So anyway, where’s the report? Also isn’t Cinquegrana, Choate Hall and Stewart, and the SJC in violation of an number of judicial and legal canons of ethics by creating the appearance of a special relationship between them? Especially when Choate Hall is doing this for free.

BTW – the best thing that came out of the Globe drunk driving series was the admission by by the State Police that unlike many other states they do not have dash board cameras filming OUI stops.

Why? Well because, according to the state police spokesman. ‘it results in not guilties’. Huh? Truth be damned.

Unfortunately because of all the quid pro quos going around the Globe didn’t report this little admission as a civil rights issue. What bothers me is it appears they didn’t see the problem with the statement. Otherwise they would have pounced on it or not printed it.

Who knows? Too many fucking layers with these people.

Like everyone on Beacon Hill I am anxiously awaiting the feds next move on the Probation investigation.

I wouldn’t expect any news, if there is news, until after the election?

BTW, my reading of the state and federal indictments against O’Brien seem very weak. The vagaries oh the statues especially with the facts behind each indictment may result in the cases never getting to a jury.

O’Brien has federal defenders representing him at the Moakley Courthouse. Not some hit or miss guy from Quincy. He will have top grade representation who will hold the feds’ feet to the fire.

Credit where credit it due. Yeah Dan Rea bugs me, but he is one of the few in the press who works at spreading the word of the wrongfully convicted. That goes a long way.

What mission is that? Why the mission to get Scott pissed off so his angry yet shallow inner-self shines bright during the debate.

Now when this is done right it is a work of art. Done seamlessly and naturally. Organic even. It can also be spiritual.  When done by the pros it can be breathtaking.

So work on those hand painted signs and shout outs for Scott to see and hear. The goal is to get under Scott’s skin. I’m sure there are some old time union guys who can work this. It would be fantastic if it can be done Chinese water torture style with a few drops hitting him throughout the day.

Marinate Scott so he explodes by the time the debate starts.

If Scott is challenged, even barely, he flips. Opposite of a consensus builder. I hope yo have a few doo dads in your purse to help it along. Can’t rely on moderator.

Really, only a fraud has a pick-up truck when he has no need for it. This ain’t Texas. Is Scott in the trades? Does he plow on the side? Who needs a pick-up truck when you don’t need one? Everyone asking to help move furniture and stuff. Of course Scott’s friends probably learned a long time ago not to bother asking.

2. “What is sub-prime loan?”

We know Scott can’t define exactly what it is. And Scott denies that as a closing attorney representing mortgage companies during the height of the housing market he ever closed on a sub-prime loan. That’s like the usher at Fenway saying in his all his years he never saw a fan wearing a red sox cap.

3. “What state and federal benefits did your mother and you receive and which would you eliminate, expand, or down-size?”

4. “How’s your mother doing Scott?”

She’s still alive right?

5. “How’s your aunt in NY doing Scott?”

6. “Is it true your barn jacket cost $900.00?”

7. “If Gail wasn’t a music video model would you have asked her out? Conversely if you weren’t a male model would she go out with you?

Not a bad use of John Henry’s $700 million by people considered to be buffoons and too cheap to spend what it took to win.

Ernie, is this the same Fidelity National that was a pioneer in manipulation of borrower’s information, robo-signing, and blatant fraud  during the housing bubble?

Is it fair to wrap this around Scott Brown?

Well of course I thinks so, but so does A-1 financial expert and blogger Alan Jevitin. Check out this gem:

Brown’s association raises a host of questions. Who were those “mortgage companies” that he worked for?  What did Scott Brown understand about the mortgage market he was facilitating? Did he recognize that there was a bubble?  (He was a town property assessor at one point, so one would think he’d notice this sort of thing.)

If not, what does that say?  And if so, what does thatsay? How many predatory loans did Scott Brown facilitate?  How many of the loans where he handled the closing resulted in foreclosure?  What would he say to those families that lost their homes to predatory loans?

Now here’s a guy that knows what he’s talking about:

Brown said that he thinks character is an issue and that it is the litmus test for being a Senator.  Mere compliance with the law isn’t always a passing grade on character.

And just to be perfectly clear Levitin reminds us that carrying water for Wall St. is carrying water for Wall St. regardless of how high on the ladder.

At the very least, it looks like Scott Brown was riding the mortgage bubble, serving as a cog in the machine.  We know that Senator Brown was carrying water for Wall Street when (as his singular notable Senatorial accomplishment) he weakened the Volcker Rule that was aimed at preventing federally-insured banks from engaging in risky heads-I-win/tails-taxpayer-loses trades. Was undermining the Volcker Rule just a continuation of a career carrying water for the banks?

Scott’s a tool. A good looking tool, but a tool nonetheless.

Note: This is not a knock on closing attorneys and yes it’s hard to blame Scott for the housing crisis. But REMEMBER!!!! What would Eric do?

And Scott Brown threw his mother under the bus. Don’t forget that either.

Questions:

How much did Scott earn from representing banks and mortgage companies during the years he held elected office?

Did Scott see any warning signs in his review of the loan documents for any loans?

When in relationship to his elected positions did he get these financial institutions as clients?

Was he on any committees in the legislature having jurisdiction over any banking issues?

What votes did he take during his time in the legislature that affected his financial clients?

When he was in in the legislature what positions did he take that were good for his corporate clients and bad for consumers?

Massachusetts is one of a small handful of states that requires an attorney certify title for every residential loan. That is why we always have a lawyer conduct a closing. It’s the law.

What it really is is a ‘nice ting daye ave goin’. So nice that Scott was pulling in over a hundred grand a year by having these mortgage companies send him closings.

Every year there are bills filed in the legislature to stop this oligopoly that fail. Bills in his committees perhaps? Votes he’s taking? Letters he’s written?

Think of the people underwater and foreclosed on because of loans Brown was representing mortgage companies on? Well I’m not Kreskin so thinking won’t help. Someone has to do the research.

Remember this surrogate Warren supporters, this is your America too. Elizabeth Warren and Scott Brown can’t tell you to keep your mouth shut!. So if you have the dough and wherewithal to make noise than time to get rolling. Raise some money for charities.

Scott Brown humiliates and destroys women’s reputations, including his mother’s, grandmother’s, and aunt’s, for political and personal gain. How much money did he receive from the book publisher to kick the crap out of mommy, grannie, and auntie?

Where are the fans from two years ago? What the hell is happening here? He’s a U.S. Senator and he can’t turn out the bodies for a simple pre-debate sign holding. Tim Murray could do this blind folded.

Where are the headquarters overflowing with volunteers. What about the canvassing and phone calls? What happened? What’s changed in two years? Why can’t Scott get it going?

So what can you do? Tell your less informed friends that the real story is Scott uses and disrespects women. The story he tells is highly shaded and somewhat bizarre. He has family members and friends contradicting important facts. He pimped out his mother’s failures to get elected and sell a book for big big money.

And he will vote for Mitch McConnell for majority leader so when it’s time to man-up for MA, when ole Mitch puts his arm on Scott’s shoulder and asks for that much needed vote that will essentially fuck Massachusetts, you can bet Scott will do exactly as asked. The rest of the time Scott can take safe votes against McConnell.

Not to mention Grover Norquist who will remind Scott of his vow to vote against a bill that cuts taxes for everyone but slightly raises it for incomes of one million or more.

The extreme results of the no tax pledge to only benefit the very wealthy is not an anti-tax policy.

For those who want to help but aren’t official volunteers time to act alone or  organize for the next five weeks and play to the masses. Just like Eric does.

The point is to repeat very basic themes om Scott’s Brown’s character.

Scott’s treatment of women is an issue. He is weak there because he relies on it. Built his game plan around it. Time to exploit it. Time to make sure the pony tailed mom in Wellesley with the B.A. from Duke who is a registered independent knows this. Conservative women need to know it also. They may blank it.

His ‘student in classroom’ remark is a symptom. Note the hostility in his demeanor during some of his answers. Close your eyes and listen. He sounds like a scared little boy trying to explain himself to a teacher. And he resents it. How dare he be questioned on anything.

Keep hitting and hitting and hitting and hitting and hitting on this. Like Eric would do. Raise the issue of the appropriateness of him throwing his mother, grandmother, and aunt under the bus in his book and public comments.

Does anyone notice that Scott’s view of things is always one sided? The narrative he’s created for himself seems too perfect.

Sooo, to get it going let me suggest a few things that people can do on their own or in groups:

1. Have a mass of people calling into talk radio knocking Scott. Not supporting Warren but knocking Scott. This needs to be down in mass because screeners will not let anti-Brown calls through. Bombardments of calls to each show will tie up some tea partiers from getting through and have other benefits. Hi-jack a show with 30 people pushing redial. If necessary lie to screener about nature of call. Imagine having people lined up everyday for every shitty talk show.

That’s what Eric does.

2. Make some hand painted signs saying “What’s Scott’s Problem Women?” or something like that. Have a few knuckleheads yell “Scott, why do you keep throwing your mother under the bus?” Get a chant going. Have old ladies yell it.

And don’t forget the rogue union guys singing “Real Men don’t exploit their mothers”. Scott will flip. Show him lose his cool.

Make this the coffee talk issue. Get people thinking about this.

This is what Eric would do.

3. It would be nice to see some well edited videos of Scott saying demeaning things to and about women.  Is he a modern man or a man of the house that uses his wife, kids, and other past and present women in his life to feed the movie running in his head? I  mean shit, since when does having a wife a two daughters make a man a feminist? WTF

This is what Eric would do.

4. It would be great if someone followed Scott around with video cam. BMG sanctioned volunteer would be great. Post stuff constantly. Little stuff. Not gotcha. Just showcasing him for what he is. One on one with voters and at speeches.

A pattern of Scott’s not so good tendencies to get defensive over little things and his lack of respect for women in authority should start to materialize.

Of course the Warren campaign records him but things coming from campaign have different criteria than coming from rogues.

This is what Eric would do.

5. Be creative, use what you have and exploit it. Think like Eric Fehrnstrom.

That’s what Eric does.

It would also be nice if Scott’s asked to explain his representation of sketchy mortgage companies for loans that most likely included language that Scott’s clients knew or should have known would result in the borrower defaulting. How many “no-doc” loans did Scott represent the mortgage company on?

This of course only as an attack after she is forced to defend her professional background.

BTW Warren has credentials to represent her clients. Other than being a legislator what credentials/ training did Scott have? When in relation to his elected position did he start getting financial institutions as clients?

What votes in the legislature did he take that were favorable to his banker clients and a heavy handed slap to the person paying their mortgage on time?

As for the surrogates, remind people that Scott is anti-women. He pimped his mother’s illnesses out to help his election and sell a book. My god he won’t let anyone forget it. He brings it up more than the Red Sox ownership reminds us how good things were years ago.

Am I the only one that finds Brown’s familial disloyalty not only bizarre but anti-American, wait, anti-human. Imagine building an identity around one’s mother’s failures. Especially a political identity. Uncool dude, uncool.

Anyhoo, Glass Jaw Scott Brown throws wild punches, is not quick with counter-punches and allows his emotions get the better of him when hit hard. And…. he’s never been hit hard.

He only knows sound bites that Eric “See You in Hell” Ferhnstrom feeds him.

After that he’s like…”Oh yeah! Well you lied about being an Indian, and you represent insurance companies, and you make a lot of money and you’re a four-eyes, and and you think you’re sooo cool. Well I gut news for ya sweetheart, you’re not cool. I’m cool. I’m Scott Brown cool.”

Scott will loose it even more when Warren kills him with kindness as she constantly jabs with quick facts forcing Brown to defend himself with all the rhetorical muscle of a third grader.

And of course Liz will have one or two attempts at a knock out punch.

Bottom line, the guy’s a wuss with an ego and position dwarfing his intelligence and ability and he has a  pretty boy temper problem.

So I’m hoping that tomorrow Miss Lizzie will bring out the worst in Scotty.

The details of the Amy Bishop murder in Braintree raise obvious questions that should not be ignored. A murder was committed that was not properly investigated resulting in the guilty going free and killing again.

The facts indicate gross negligence with no accountability. Were any law enforcement officials pressured, bribed, or blackmailed?

Why isn’t there an independent investigation? Where is the special investigator on this? What involvement did past and present Norfolk district attorneys, assistant district attorneys, and police officers/state troopers have in the initial cover-up.

Was/is there a cover-up by the Norfolk County District Attorneys Office post the Alabama shooting?

Why is that office investigating themselves?

Can D.A. Michael Morrissey point to other homicide cases in Massachusetts where the Commonwealth decided not pursue charges? For any reason at all?

These are all proper questions that seem to be going unasked by the press and Martha Coakley.

Does this pass anyone’s smell test?

The reason given?

“We will not move to have her returned to Massachusetts,’’ Morrissey said. “The penalty we would seek for a first-degree murder conviction is already in place.

Rule – Murder convictions are always followed through on. Always. Never leave the file open unless absolutely necessary. No conviction means open file.

Background: In 1986 Amy Bishop shot and killed her brother at their home in Braintree. She then took the same gun and ran next door to a car dealership (Dave Dinger, remember?) and attempted to steal a vehicle at gunpoint. There may have been a speck of kidnapping too.

Anyway it was of course a big effin’ deal. Amy was put in cuffs and locked in a cell at the Braintree police station.

Later that evening Amy was released and it was like it never happened. Community amnesia. Off to Harvard.

Facts not in dispute: Under Mass law, and unlike all other crimes, the district attorney is in charge of investigating all homicides, possible homicides, and wrongful deaths. Their office is the first one called after the emergency response folks.

Homicide detectives assigned to the D.A.’s office are lead investigator;s while local cops hang back. Usually an assistant district attorney arrives on scene and many times the D.A. himself.

Two Main Points: Impossible for the D.A. at the time, Delehunt, not to have known or should have known within 30 minutes of the homicide and attempted escape.

And:

The Braintree police would never release the suspect with out an Okay from Delehunt’s office.

When the shit hit the fan a few years ago current congressman Bill Keating was the Norfolk D.A. and a candidate for the seat Delehunt was leaving. He could not offend so his investigation, and I assume the still under seal judicial inquest, avoided the issue of D.A.’s responsibility.

Next up is current District Attorney, and like Keating and Delehunt a former state rep and senator and a close friend of Keating, Michael Morrissey.

“Nothing to see here” he declares today.

Why is he even deciding this matter? It should be sent out to another D.A. to prosecute. The appearance of conflict and violations of legal canons and ethics are all over the place.

Remember, this is murder.

Speaking of prosecutorial ethics how about Martha Coakley bullying some magistrate to give her an arrest warrant for the crazy drug lab chick? Martha then of course had all the press present for the “execution” of the warrant at her Franklin home.

Arrest warrants are given when it can be shown there is a risk of flight, danger to the community, nature of charge, and/or a few other factors. The ones present in this case indicate the arrest warrant was an abuse of process.  The criteria was abundant with facts favorable to the defendant.

Typical Martha.

According to Boston Globe Scott Brown labeled his maternal grandmother a “loose woman”. Brown had never met the woman. Her daughter, his aunt, was stunned and emotionally wounded upon reading of his description.

The aunt, like many in Scott’s early life, remember things a little differently. Scott wrote in his book that this aunt and her family invited Brown to visit them in NY and they denied him food and treated him like garbage. The aunt described for the Globe a more realistic version of events.

And let’s not forget his mother. How can we? Scott reminds us over and over that she sucked as a mother. This was the basic story he pimped to a book a publisher. What would Jesus do? Why exploit his mother’s failings for profit and personal gain of course.

Like many people Scott’s mother had a drinking problem that lead to some bad choices. The effects can be lasting on family members. Especially children.

Scott and company have been great at fooling the masses. But the masses are fickle.

“Hi, I’m Scott Brown. My DNA is one hundred percent white-trash-scum-bucket-garbage. And yet  I overcame it. I am the greatest man ever. Anyone who questions this is un-American”

The woman voter may quietly turn on Scott. Not all. Just enough to make a difference.

The “my wife and beautiful daughters are better than yours’ routine may also being playing thin.

And BTW unsolicited advice

Comb through the Mass court records. See who Scott’s represented over the years? What is/was his law practice?

Real estate conveyancing? What banks sent him business? Ever represent a a guy for a 209A violation? Divorce? Great shit in divorce cases. Go to each district, superior, and probate court and check for his appearances.

Next debate hit Brown with at least two bombs. Legitimate ones. Put him on defensive and keep swinging. He’ll cry like a baby.

I’m sure the pros working for Elizabeth Warren are pulling what’s left of their hair out  convincing her to answer the Travelers and heritage issues in a clear decisive ten second sound bite. if apology needed  somewhere on the heritage issue than make one and move on. Scott won’t know what to do,

But after the soundbite hit him in the balls with a vote he took and a client he represented. I think he did a lot of real estate closings. Great if true. Scotty was paid by banks to push through shitty loans.

How about that. I count 20 Globe employees plus Negri in the picture from the cake-and-ice-cream-in-the-conference-room-type event.

Now in this random sample of Globe newsroom employees I don’t see a single face (or hand) any darker than “Richie Cunningham Cream” on the Tourraine Paint swatches.

See what I mean? Like their business partners at the Red Sox they are real good at calling others bigots, preaching ethics, and generally gleaming with moral arrogance as go through life promoting their self-sustaining brand of elitism.

What frauds.

Or maybe Negri just didn’t make friends with any of the black employees?

And maybe she personally sent out the invites. The building’s full of brothers and sisters with jobs like the people in the picture. Gloria just didn’t want them at her party.

Yeah, that’s the ticket.

Anyway, as we all know that was bullshit and last Thursday we saw the result. Rep. David Torrisi had the audacity to vote against Deleo’s very important tax bill, not to mention he was the only Democrat not to vote to re-elect Sal as Speaker after the writing was on the wall.

So Torrisi had to go. Send a message to the others. Maroon took care of it and redistricted the fuck out of him.

Last Thursday Torrisi lost his primary battle. Just like he should have in the world of the House leadership.

But wait. Holy Shit! Guess who beat him? Deleo, Mariano, and Dempsey never counted on this. The new Democratic nominee to the House is the same young woman who was fired from her job a few years ago as an aide to a lame Republican state rep.

Anyone recall this? Bueller? Anyone?

This was the female aide that was invited to a later night/ early morning party in the speaker’s office after the budget or some other late night session. This young impressionable female aide was in the big guy’s office with Mariano and other very powerful people.

At some point a young freshman and also single state rep. offered to show the young female aide the House Chambers. In the speaker’s office there is a door that leads to the chamber stage right of the rostrum. The door was unlocked and under the circumstances completely appropriate for a rep to walk someone in there.

Unfortunately for this young  woman while they were in the chamber the old timer court officer arrived for his daily 3:30 a.m. shower. This guy has been there so long that his sponsor was Charles Bulfinch.

So the old timer sees them and didn’t like the fact that they were interrupting the same routine he’s had for a bazillion years. Turns out there was hell to pay and the one who paid was weakest person in the vicinity.

It became a story and the DeLeo added fuel to the fire. The Republican rep she worked for showed what a huge wuss he is and fired her.

Well boys and girls, if she holds back the Republican challenger she’ll be back. As one of them. After they screwed her big time and forced her into near poverty (her story post firing is compelling) she’ll be in the House telling her freshman colleagues and reminding the veteran women reps what these bastards did to her. And don’t forget the male reps’ wives and daughters.

“These bastards” meaning DeLeo, Mariano, and Dempsey. The guys that want to take the House back to 1965.
