A federal judge ordered immigration officials yesterday not to move out of state any of the remaining detainees from Tuesday’s raid of a New Bedford sweatshop and to allow them access to lawyers.
Judge Richard G. Stearns also instructed the state Department of Social Services and the Immigration and Customs Enforcement agency to work together to solve the problem of detainees who are mothers or primary caregivers and have been separated from their children. He ordered those agencies to give him a progress report by Tuesday.
Gov. Patrick is on the job. ICE is still lyin’ its ass off:
Eight minors were picked up during the raid. Three of them have been released, but the remaining five were taken to a facility in Miami. The immigration agency was in the process of getting them back to New Bedford, said spokesman Marc Raimondi.
“As we have been doing since before the enforcement operation began, we continue to coordinate closely with our federal, state, and local counterparts, including DSS,” Raimondi said. “The fact that DSS has not notified us of a single child in a risky or inappropriate setting. . . . says that the cooperation between us has yielded the results intended.”[my emphasis]
And we haven’t heard of anyone in that Convention Center, either.
Just amazing.
anthony says
….that settles the issue of whether the detainees have any legal rights.
<
p>
I must say, the fact that anyone even thought to contend that these people were absent any legal rights just because they presumably are not citizens was more than just a touch frightening.
joets says
I was simply contending that they didn’t have full protections accorded by the constitution.
anthony says
…you who made statements about their rights. There was some contention that they had none, if not made by you.

…example.
amberpaw says
According to the press, attorney Harvey Kaplan is the advocate who brought this into court and slowed the “runaway train” from ICE – that at least for me, and a frighteningly fascist flavor.
raj says
…this is stupid.
<
p>
Well three words.
<
p>
GPS ladened ankle bracelets on the detainees would suffice to ensure that they would be available for their ICE hearings. Physical detention is completely unnecessary.
<
p>
What the f@ck do the feds think they’re doing?
<
p>
I sincerely cannot figure this out. If the Bush malAdministration wanted to make an issue out of immigration, they would have done it before the last election. Not now, when the Bush malAdministration is in its last throes.
<
p>
Something is going on here, but I cannot figure out what it is. But the actions of the Bushies make no coherent sense. This plus the raids on the five (or more) meatpacking plants in the mid-west make no sense.

Will ICE repaly Massachusetts for the costs of housing all of these folk, rounded up and held without hearings, and scattered all over the state? Will ICE repay the DSS line item for flying 18 DSS workers, including Commissioner Spence, to Texas? Who is taking care of the cases involving abuse and neglect of children that these 18 DSS employees are leaving behind?

…it’s budget time, guys. And, an agency that wants to have an increase in its budget has to show that it is actually doing something–regardless of how destructive of what it’s doing might be.

It’s about money. It’s always about money.

In the larger scheme of things:
<
p>
1. Does Deval have a target on his back because of his Democratic victory in this state?
<
p>
2. Does the Bush misadministration have a bone to pick with him? Who ordered this action?
<
p>
3. How does former misGovernor Willard play into this? Was this set up prior to his leaving office?
<
p>
This is some damn nasty, fucked up shit. Only extremists could put this together. Really plays into election year issues if you know what I mean.
<
p>
Will the MSM start digging? Probably not.
sabutai says
We can agree that these raids are a bad idea conducted in an incompetent manner, but it’s not about Deval (yes, it’s true — some things in this world aren’t).
<
p>
These ICE raids have been conducted in many parts of the country, including Texas. And Deval would be low on any Republican hit list regardless. If this happened in Cincinnati or Phila you could have an argument. I think Kai’s budget hypothesis is the best one I’ve yet seen.
lolorb says
It does seem more than coincidental that there was a target in MA. Willard just departed.

I think I said in another thread: my guess is that they want to make a point, but in places where the Hispanic vote is numerically unimportant. We will never see type of fascist pounce on shops in FL, for example, where Hispanic vote is important to Repubs.
joets says
The huge raid in Arizona last night?
joets says
Not huge in the number of illegals detained but rather huge in impact; this was a raid specifically to get the owners of a company–which is what you guys advocate, yes?
stomv says
don’t advocate for anything uniformly, so use care with the breath of your brush.
<

Many folks, including many liberals, argue for going after the employers of undocumented workers. That’s much different from going to the place of employment to round up undocumented workers.
laurel says
Sure, lots of Hispanics in AZ. But it is well known that they have poorer voter turnout than whites. When/if that changes, watch how the feds handle the illegal immigration issue change.
goldsteingonewild says
never is shorter than it used to be.
<

and i suppose that the hispanic vote is not important to R’s in colorado.
<
p>
for better or worse, immigration raids are WAY down under bush than during clinton’s tenure.
laurel says
My prediction was that they wouldn’t be of the fascistic sort seen in New Bedford. You know, orphaning American kids needlesly. More’s the shame on Bushco if I’m wrong.
raj says
…Not all Hispanics are alike. The Republicans are going to cultivate the Cuban-American vote, who look for the day that they can reclaim their lost property in Cuba. Hence the American embargo on trade with Cuba. Hence the faux uproar over the Elian Gonzales case–remember him?

stomv says
if an ICE agent storms in to your place of work and starts rounding up non-citizens, could you prove you were a citizen? I certainly couldn’t on the spot, and would have a hard time doing it within 24 hours.

p> * My drivers license is from another state and expired (I don’t drive anyway). * My passport expired 3 months ago. * My birth certificate is almost certainly in a firebox in my parents house 600 miles away. * So is my original social security card.

Would I be shipped off to Texas or Miami? That ain’t cool.
mcrd says
The Governor’s first act was to halt the state police from enforcing immigration law. He stated that it was a federal responsiblity. The feds come in and enforce immigration law and there is howling. What gives ? These people are here unlawfully. They are taking money out of my pocket, out of my school system, they are flooding my hospitals, overcrowding my children’s classrooms, causing epidemiology problems, engaging in insurance fraud, being arrested at a disproprtionate rate for drunken driving, larceny and murder, stealing legitimate citicens ID and screwing up social security and IRS and lowering the local wage scales and undercutting my bids on jobs that I feed my family with and pay my taxes.
<
p>
They need to be rounded up and sent home. They came here of their own volition, unlawfully. Go down to Mexico and commit a crime and see what you get!

their 7 month-old children. Those little punks get what they deserve, right?
david says
but you probably speak pretty good English. And they aren’t raiding those notorious factories that employ undocumented anglophone Canadians. You’d be fine.
mcrd says
There are far more Francophones from Quebec here that anglophones from the remaining provinces. There are no canadian sweat shops around here that I am aware of. A Canadian is not going to work for eight bucks an hour and their dole is a lot better than hours. It’s their tax rate which is nearly twice ours that is the killer. People go without in Canada to keep the dole going—-Quebec being the worst offender. I may live to see the country of Canada break up in what years I have remaining.

I have illegals now under bidding me and my fellow contractors all over SE Mass. How—? They don’t pay workmans Comp, they don’t pay withholding, I contribute 20% to my employees healthcare and I pay a weeks vacation. I pay gas if we have to drive over twenty miles and the foreman has a company truck. The illegals are cutting my bid by 50% due to aforementioned . I have four kids in school and one about to go to college. If this continues I will be out of business in one year. I have always been blue collar, always voted democrat and now the party I have been loyal to these many years is about to destroy my entire life. For what—–people who elected to break the law. I thought we had courts and jails for lawbreakers.
