BlueManSue, I suggested recently that Team LaGuer’s new strategy was going to be to deny that a rape occurred. Charley, one of LaGuer’s defenders here, disputed my claim. And in fact, in the NECN clip, LaGuer’s lawyers seem to be at pains to avoid saying “there was no rape.” (See the partial transcript of their comments here).

p>My comment was a short-hand way of saying that I think the new legal team is prepared to argue, more explicitly than they did before, that there was no rape. I do think this is problematic, for reasons I’ve given before (e.g., here and here. I also think that, in general, the attitude of LaGuer’s supporters is that LaGuer is entitled to a new trial unless the government could, today, prove his guilt beyond a reasonable doubt, when in fact the issue is whether he had a fair trial at the time. These issues have been extensively discussed, e.g., here and here.

p>Seriously, I’d like to know what, exactly, the game plan for LaGuer is. Is he going to move for a new trial on the grounds that the DNA evidence exonerates him, since it shows there was no rape?
