Join the Impact MA has launched a postcard campaign to pressure the Obama Administration not to defend the Defense of Marriage Act in the constitutional challenge being mounted by Boston-based GLAD. The Justice Dept. must answer GLAD’s complaint by 29 June. Under fire is the provision that withholds federal law benefits to same-sex married couples in the 5 states that currently allow for it.
While the Justice Dept typically defends laws faced with constitutional challenge, the Executive Branch has a certain amount of discretion it can exercise. Given Obama’s position that marriage should be a matter for states to decide, the intrusion into state sovereignty represented by a federal definition of marriage (for one purpose only) is indefensible. Standing by DOMA would be tantamount to a flip flop, especially in light of Obama’s 1996 statement that he supported marriage equality.
