…but the Governor shouldn’t be denying the choice to those who do want it.
I guess the court will settle it, but it seems unconstitutional.
Some interpret the 10th amendment to prohibit the federal government from doing anything not listed in Article I, section 8 of the Constitution. This goes back to the Virginia and Kentucky Resolutions and the Nullification Crisis. I think it’s pretty settled at this point that the federal government has broad powers. The strongest argument would be that since providers operate in multiple states this goes to interstate commerce.
Is that the Union won the Civil War.
