The recount did not change the vote count in four of the five towns. However, Mr. Alicea picked up three votes in Southbridge to cut the margin of victory to one vote Thursday.
Mr. Alicea said as votes were being counted yesterday that if nothing changed in the recount in Oxford, he would go to court over an uncounted absentee ballot from Southbridge.
“It’s a process that could take several months,” Mr. Alicea said.
If he is ultimately awarded that vote and a tie is declared before the start of the next legislative session on Jan. 5, then the seat would remain vacant until a victor is declared, Mr. Alicea said.
On the first day of the House session, a clerk would direct that no one had been elected in the 6th Worcester District, at which point the House would decide what to do, with one option being a special election, according to Brian McNiff, spokesman for Secretary of State William Galvin.

A challenged ballot exists. Is it your position that this voter should not have a full review and have it determined if his/her vote is valid or not?

Mr. Durant may well be the same if he makes it into office. I don’t need to dump on him because he wasn’t my candidate. This one vote will matter greatly to the District.

The judge can argue that the machine spit it out and therefore the vote doesn’t count and that’s one of the chances you take voting absentee (especially on a very sloppy ballot) or he could argue the intent of the voter was to vote for Alicia and count it. I think the judge will count the ballot eventually, and it’s an Alicea vote.
I speak to many non-Democrats. But I did not discuss the ballot issue with any of them. That would not be appropriate.
