p>Obviously, I don’t agree with the ruling. I also find it interesting that Alicea now says that he has been taking a paycheck since January 5th when he said he wouldn’t.
<
p>Now we wait and see if the House will abide by the judge’s ruling for a new election, or just seat someone as was done with Patrick. If that happens, this will go down as more proof of how an election can be stolen in Massachusetts.

but why “don’t agree?” What portion of the case do you think was misunderstood, or otherwise not handled appropriately?
Durant, who is currently a selectman from Spencer, could not be reached. But his lawyer, Frank L. McNamara, Jr., said he had not yet discussed an appeal with his client.
“I’m disappointed because I wanted Peter to win, but the result is not unexpected given the evidence,” McNamara said. After hearing testimony from a local election official who handled the disputed absentee ballot, “It was pretty clear that that was going to be counted as a vote for Alicea, thus tying the vote,” McNamara added. “But it was a fight worth fighting.”

Thats just resignation as to how the system is rigged!
Hey Gerry: Be prepared to explain that $500,000 promise Southbridge was supposed to receive as payment on your vote for gay marriage.
One small consolation: Republicans have local activists already in place. Union thugs won’t work this time.
Hit us with your best shot! But no crying when you lose a second time.
When Judge Cannon ordered a special election in Patrick vs. Wheatley, the House voted to seat Patrick with no election as ‘the House chooses its members’. DeLeo is already hedging, saying that a special election is just ONE of several options.
<
p>Of course, he can just do nothing at all and keep Alicia as a holdover for two years – he’s already collecting the paycheck, after all. That would be a typical Massachusetts Democrat solution.

Wasn’t the count one in favor of Durant before the challenged ballot created a tie? If anything that would make Durant the default winner and HE might plausibly claim the paycheck until otherwise resolved. Yes, the House DOES have the right to judge its own election returns.

Alicea over as a holdover. If you go to the members page Alicea is still listed.
I think its way to volitile to force members into such a hostile vote.

I obviously have disagreed with what has happened to this point. If a Patrick appointed judge who has donated to several Democrat officials and a super-majority House is allowed to steal this election, I’m not sure they can shake off the stench this time.
<
p>I don’t think DeLeo would be as brazen as 2001 given the recent history of indicted Speakers. He knows that the feds are paying attention and wouldn’t risk his tenure on Alicea when millions of dollars (casinos) are at stake for his district.

You’re welcome to combine the judge’s political history with some legitimate complaint about how the case was handled, but without that legitimate complaint you’re just whining.
<
p>2. Given that the Lege has wide latitude in controlling their membership, your connection to “the feds” is asinine.
You too are beginning the ‘wide latitude’ soft soap? Reminding people that while the Legislature still quaintly allows people to vote, the arbiter of who will ‘represent’ the electorate is still the Democratic Party, the way God intended?

p>It has nothing to do with what I want the Democratic party leadership to do (which is not seat anybody until an election fills that seat). It has to do with calling out nonsensical posting… claiming that people are “steal[ing] the election” without a shred of evidence, and then alluding to “the feds” and Deleo’s “tenure” as if Deleo choosing to seat Alicea would violate federal statute.

but I’d never use the male-geslature website as evidence of everything. Heck, on just that page:
* one legislator doesn’t have an area code
* (identical) email mappings suffixes include

– state.MA.US
* email prefixes sometimes using caps, other times not
* no space between the F. and the D. of “Antonio F.D. Cabral” (Mr. Cabral does include a space on his facebook page)
* no comma but a period for “Thomas A. Golden Jr. ” but a comma and no period for “Donald F. Humason, Jr ” (both a comma and a period are correct)
