Trump recently said that he would consider jailing or revoking citizenship if a person burned the flag.
But his idol, the late Justice Antonin Scalia, disagreed — arguing that flag burning is protected under the First Amendment.
In a 2012 interview Scalia said ; ” If I were a king, I wouldn’t let people go about burning the flag. However, we have a First Amendment which says that the right of free speech shall not be abridged, and it is addressed, in particular to speech critical of the government. I mean, that was the main kind of speech that tyrants would seek to suppress. Burning the flag is a form of expression. It is an action that expresses an idea.”
Well, there it is. That just about sums it up. For the first time in my life, I find myself agreeing with Scalia. Even a broken clock is right twice a day.
