The Globe’s Milton Valencia does an excellent job of actively, and quite impressively I might say, playing the incompetent fool for assistant U.S. Attorneys Fred Wyshak and David Margolis not to mention his bosses at the Globe/NY Times whom I am seriously beginning to believe Team Wyshak/Margolis have pictures of.
Yesterday Whitey’s lawyers were in court asking the new Judge to overturn a decision made by the prior Judge, Richard Stearns.
Stearns was removed from the case after appellate decision written by former U.S. Supreme Court Justice David Souter ripped him apart in an unprecedented manner. Stearns extensive involvement personally and professionally with many of the witnesses and not stepping aside on his own motion was beyond credulity and had Souter perplexed. But the fact that Stearns doubled down and fought to keep the case made Souter go Sonny Corleone on him. In the judicial sense I mean.
The decision is historical for the shear contempt that Souter shows for Stearns’ actions mirrored against his judicial efforts to keep it polite.
BTW, there has been so much poppycock thrown around for years and years on all things Bulger that even Souter fell into the trap when he wrote in his opinion that John Connolly was convicted of crimes while in fact he was acquitted. That’s lazy law clerking I bet, huh David? Google and read Howie Carr to get facts rather than check the court docket?
So anyway in comes J. Carney and asks the court to re-open the issue of immunity, a lynch pin in the case that could open up serious wounds for some of the individuals on the witness list who Stearns had prior professional relationships and current personal relationships with.
Judge Stearns denied it in a most expeditious manner relying on a last minute open ended affidavit filed by Assistant U.S. Attorney David Margolis, the 50 plus year career Justice Department attorney who calls himself the “fixer”.
Okay people, gut all that? Because here’s a piece of how the Pulitzer Prize winning Globe had to report on the hearing
Bulger’s lawyers had asked Casper to vacate the decision made by US District Court Judge Richard G. Stearns, who recused himself from the case out of concern that he would have a conflict of interest in overseeing the trial.
Do you see the injustice here? Do you see this perverted sexual act between the U.S. Attorney and the Globe being played out in full public view. CHILDREN ARE WATCHING!!
These people are so powerful they don’t care who knows.
The Stearns recusal issue is a perfect example of the corruption and or undue influence the Justice Department has on our independent judiciary.

The above is an example of the larger issue.
The larger issue is not about any Bulger. It’s about the rat infested Justice Department and the harm it is causing. Whitey’s case has attention because it is sexy.
Take a look a what they did to Ted Stevens. They changed the balance on power in the Senate by using an illegal and corrupt indictment which resulted in calls for criminal indictments against the U.S. Attorneys involved.
Nothing happened.
There is a corrupt element within the Justice Department and the The Boston Globe and The Boston Herald, among many other media outlets, have been corrupted by it.

A “rat infested Justice Department” is wrong, and that wrong should be corrected. Whitey Bulger and John Connolly are each criminals and murderers. There is no dichotomy among any pairing of those three facts — all three are true.
I gather you use the term “rat infested” in a different sense that Mr. Bulger and his ilk use it — you are presumably not complaining that there are too many underworld informers in the FBI (but who knows). Comparing the Whitey Bulger case to Ted Stevens is a stretch, even by your standards.
As far as I’m concerned, pieces about Whitey Bulger belong in the same dustbin as pieces about the Red Sox and the Pope. Mr. Bulger is sleazy murderer who is rightfully incarcerated, and is likely to remain so for the rest of his life. Mr. Connolly has already been convicted and incarcerated, has appealed, and has lost his appeal. He, too, is no longer a threat to society. I already know all I care to know about these scumbags. I don’t like “holocaust porn” (you know, “heart-rendering drama that reveals the depths of human suffering and depravity inflicted by Nazis…”), and I’ve had enough of “Bulger Porn”.
Whatever will happen to the Justice Department will happen. I think there are far worse problems in the Justice Department than whatever skeletons lurk in the Whitey Bulger closet.

Connolly did not kill anyone. The jury in Boston acquitted him of anything to do with murders. Did you know that Tom?
So much more. Really tom, if you are interested I suggest you start following retired prosecutor Matt Connolly’s blog.
Matt was top guy in Norfolk County spending most of his time trying to get Whtey and crew. Little did he know John Connolly was running interference.
Years later matt starts following John Connolly’s trial with full expectations of learning about the corrupt agent. Instead he was appalled at what he has learned.
This is what I’ve been following to learn. Matt backs up his blog with court documents, testimony, and the eye of a professional prosecutor.
It’s not about Whitey.

You really need to re-read the constitution and some of the writings by our founding fathers.
Comparing the likes of Whitey Bulger’s case to that Ted Stevens’ is one reason we are the greatest country in the world.
