Paul Pelosi should sue Elon Musk for defamation, and ask for $20 billion in punitive damages.

(Punitive damages are based not on the harm, but on providing a disincentive for further lies – and only such a sizable award has any hope of dissuading the richest man in the world.)

I realize that there needs to be reform of the shield from liability for tech companies, but this is separate and apart from that.

      He repeated multiple false claims from QAnon and others.

      My comment is a response to the thread-starter regarding the appropriate response to the assassination attempt on Paul Pelosi.

      It’s not just what Elon Musk posted on Twitter — it’s the entire seditionist movement. It’s the Fox News distortions and minimization of the attack (is anybody surprised?).

      The rule of law is being destroyed and those charged to uphold it are doing too little too late.

      After the seditionists take over election machinery in the many states they are already targeting, it will be MUCH harder for any federal agency to investigate and prosecute anything.

      It will be much harder to restore representative democracy after it is destroyed than it is to protect it now.

        The first amendment allows for stupidity, obnoxiousness, and lying, at least criminally. Only direct threats or incitement is not protected. Even lying about a public figure has to clear a very high bar regarding lying and slander.

          I appreciate you making my case for me.

          The inability to find a way to prosecute these seditious MAGA lies is precisely similar to our collective inability to find a way to prosecute the dozens of child sex abusers protected and enabled by Bernard Law and his small army of highly-paid lawyers and enforcers.

          You are describing why the already raging fire can’t be put out. The result of your argument is that representative democracy in America will burn to the ground.

          I promise you this: when these seditious MAGA Republicans seize power (and they apparently will since nobody is willing or able to stop them), they will immediately take away our First Amendment rights as easily as they destroyed a woman’s right to choose.
